Article 21-1. Ensuring the safety of military personnel of the Armed Forces, other troops and military formations, employees of special State and law enforcement agencies The Law on State Protection of Persons Involved in Criminal Proceedings
1. The safety of military personnel of the Armed Forces, other troops and military formations, employees of special state and law enforcement agencies who are protected persons is ensured by applying security measures provided for in Article 7 of this Law, taking into account the specifics of military service in the Armed Forces, other troops and military formations, as well as service in special state and law enforcement agencies.
2. Transfer (secondment) may also be applied to a protected person from among military personnel, employees of special state and law enforcement agencies, taking into account the requirements of the legislation of the Republic of Kazakhstan regulating the activities of relevant state bodies.:
1) a serviceman in another military unit of the Armed Forces, other troops and military formations of another state body in which military service is provided, in accordance with the legislation of the Republic of Kazakhstan;
2) a conscripted serviceman who may threaten to commit violence or other acts prohibited by criminal law against the protected person to another military unit of the Armed Forces, other troops and military formations.;
3) an employee of a special state body to a new place of service within the body in which he serves, or to another special state body in accordance with the legislation of the Republic of Kazakhstan;
4) an employee of a law enforcement agency to a new duty station within the body in which he serves, or to another law enforcement agency, as well as a military unit of the Armed Forces, other troops and military formations in accordance with the legislation of the Republic of Kazakhstan.
3. When transferring a soldier, an employee is appointed to an equal or higher position with the provision of his use in the main or single-profile specialty.
4. The transfer (secondment) of the protected person is carried out with his written consent.
The Law of the Republic of Kazakhstan dated July 5, 2000 No. 72.
This Law establishes a system of State measures to protect the life, health, property, legitimate rights, and interests of persons participating in criminal proceedings, their family members, and close relatives, and to ensure their safety in order to prevent unlawful interference in criminal proceedings.
