Article 7. The use of Armed Forces, the involvement of other troops and military formations, as well as government agencies to ensure martial law The Law On Martial Law

 

     1. When ensuring martial law, by decision of the President of the Republic of Kazakhstan, the Armed Forces are used, other troops and military formations are involved, as well as state bodies in accordance with the laws of the Republic of Kazakhstan to perform the following main tasks:

      1) maintaining a special regime for entry into and exit from the territory where martial law has been imposed, as well as restricting freedom of movement within it;  

      2) participation in the rescue and evacuation of the population, in emergency rescue and other urgent work, in carrying out sanitary and anti-epidemic, anti-epizootic and other measures;  

     3) ensuring the safety of protected persons and protected objects, protection of state and military facilities, facilities that ensure the vital activity of the population, the functioning of transport and communications, as well as posing an increased danger to human life, health and the environment;

      4) protection of public order and security, participation in measures to ensure martial law;  

     5) suppression of the activities of illegal armed formations, terrorists, as well as public and religious associations, foreign and international organizations, in respect of which special state and law enforcement agencies, military authorities have reliable information that their activities are aimed at undermining the defense and security of the Republic of Kazakhstan.

     1-1. During periods of mobilization and martial law, the State Security Service of the Republic of Kazakhstan has the right to use the necessary forces and means of other state bodies of the Republic of Kazakhstan in the interests of ensuring the safety of protected persons, protection and defense of protected facilities in accordance with the defense plan of the Republic of Kazakhstan.

     The head of the republican operational headquarters for security measures or an official authorized by him, from the beginning of security measures until their completion, supervises all military personnel, employees and specialists of state bodies of the Republic of Kazakhstan involved in their conduct.

     2. The activities of government agencies, the Armed Forces, other troops and military formations used to ensure martial law measures are carried out in accordance with the legislation of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated March 5, 2003 No. 391.

      This Law regulates the legal relations of citizens of the Republic of Kazakhstan, foreigners and stateless persons residing in the territory of the Republic of Kazakhstan (hereinafter referred to as citizens and other persons), as well as state bodies, military administration bodies and organizations, regardless of their forms of ownership (hereinafter referred to as organizations) during the period of martial law.  

      This Law is limited to the period of martial law.
