Article 90-5. Interaction of antimonopoly and law enforcement agencies of the Entrepreneurial Code of the Republic of Kazakhstan
1. The Antimonopoly Authority interacts with the law enforcement agencies of the Republic of Kazakhstan within the limits of its powers in the following forms:
1) informs law enforcement agencies about the revealed facts of violations in the field of competition protection;
2) at the request of law enforcement agencies, provides analytical information on the state of competition in the commodity markets.;
3) within the limits of its competence, conducts expert examinations at the request of law enforcement agencies and gives opinions on the issues of the legislation of the Republic of Kazakhstan in the field of competition protection;
4) according to the resolutions and requests of law enforcement agencies and their territorial divisions, it sends its employees as experts to participate in procedural actions and measures to investigate violations of the legislation of the Republic of Kazakhstan in the field of competition protection.
2. The law enforcement agencies of the Republic of Kazakhstan interact with the antimonopoly authority within the limits of their powers in the following forms:
1) inform the antimonopoly authority about the revealed violations of the legislation of the Republic of Kazakhstan in the field of competition protection;
2) upon requests and appeals from the antimonopoly authority:
They send employees to carry out joint activities to investigate violations of the legislation of the Republic of Kazakhstan in the field of competition protection, as well as to prevent illegal actions that hinder the performance of official duties by employees of the antimonopoly authority.;
Take measures to identify the locations of violators of the legislation of the Republic of Kazakhstan in the field of competition protection and bring them to the antimonopoly authority for administrative prosecution in accordance with written requests from the antimonopoly authority in accordance with the procedure established by the Code of the Republic of Kazakhstan on Administrative Offenses.;
In accordance with the procedure established by the Criminal Procedure Code of the Republic of Kazakhstan, decisions are taken to conduct a pre-trial investigation into materials submitted by the antimonopoly authority with signs of criminally punishable anticompetitive actions, which the antimonopoly authority is informed about.;
They provide practical assistance to the antimonopoly authority in detecting and securing evidence of violations of the legislation of the Republic of Kazakhstan in the field of competition protection.
