Article 209. Adoption by the antimonopoly authority of a decision on notification of the perfect economic concentration of the Entrepreneurial Code of the Republic of Kazakhstan
1. If, after thirty calendar days after receipt by the antimonopoly authority of the notification of the completed economic concentration, the antimonopoly authority does not send an order on the need to cancel the transaction to the person who sent the notification, the economic concentration is considered completed.
2. If the antimonopoly authority, when reviewing the notification of an economic concentration, finds that its commission has led or may lead to the restriction or elimination of competition, including through the emergence or strengthening of the dominant position of a market entity, the antimonopoly authority issues an order on the need to cancel the transaction, which must be executed within thirty calendar days.
3. In case of non-fulfillment of the order on the need to cancel the transaction, the antimonopoly authority applies to the court with a claim to compel the market entity to comply with this order of the antimonopoly authority.
