Article 221. The rights of officials of the antimonopoly authority during the investigation of the Entrepreneurial Code of the Republic of Kazakhstan
Officials of the antimonopoly authority, when conducting an investigation, have the right to:
1) unhindered access to the territory and premises of the investigation facility;
2) access to automated databases (digital systems) and other electronic media of the object of investigation in accordance with the subject of the investigation;
3) request, within the time limit set by the antimonopoly authority, from employees of the object of investigation the necessary information, documents or copies thereof related to the subject of the investigation, explanations in oral and written form on issues raised during the investigation;
4) involvement of experts from other state bodies of the Republic of Kazakhstan and other persons during the investigation;
5) inspection of objects, electronic and paper documents and other information carriers located in the premises and on the territory of the object of investigation, in accordance with the subject of the investigation;
6) making copies of documents, information from the database (digital systems) and other electronic media of the object of investigation in accordance with the subject of the investigation;
7) conducting audio, photo and video recording:
actions (inaction) of employees of the investigation facility and other persons located on the territory of the investigation facility;
premises and territories of the investigation object;
property located in the premises or on the territory of the investigation object;
8) sampling of products for examination.
The procedure for sampling products for examination is determined in accordance with Article 149 of this Code.
All rights of officials of the antimonopoly authority provided for in this article are exercised between 9.00 a.m. and 6.00 p.m. local time and in accordance with the subject of the investigation.
If it is necessary to prevent violations, the exercise of the powers of officials of the antimonopoly authority may be carried out after hours (at night, weekends or holidays).
