Article 56. The crew of the aircraft of the Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities
1. The crew of an aircraft are persons of aviation personnel who, in accordance with the procedure established by the authorized body in the field of civil aviation or the authorized body in the field of state aviation, are entrusted with the performance of certain duties for the management and maintenance of an aircraft for flight operations.
The crew of a civil aircraft consists of a flight crew and a crew other than the flight crew, including the cabin crew.
A person holds the position of a pilot, flight engineer (flight mechanic), navigator or flight attendant who are part of the flight crew and crew, except for a flight, civil aircraft of the operator of the Republic of Kazakhstan, if there is a valid aviation personnel certificate issued in accordance with Article 54 of this Law, or an aviation personnel certificate issued by a foreign state and recognized in accordance with in accordance with Article 55 of this Law.
2. The minimum composition of the flight crew of an aircraft, depending on the type and purpose of the aircraft, purposes and operating conditions, is determined by its developer and indicated in the documents on the flight operation of each type of aircraft.
3. For the period of testing of an experimental aircraft, the minimum composition of the flight crew is determined by the aircraft developer.
4. It is not allowed to fly an aircraft with an incomplete flight crew.
5. Each crew member has the right to refuse to complete a flight assignment out of fear for the safe completion of the flight in cases where:
1) feels tired or realizes that his physical or mental condition does not allow him to perform tasks according to the required standards due to illness, injury or in other cases;
2) his level of training does not meet the requirements for safe flight performance.
5-1. Crew members are required to:
1) use the provided conditions and opportunities for rest and eating, as well as plan and spend your rest time in such a way as to ensure full recovery;
2) not to exercise the rights granted by their certificates and relevant qualifications while under the influence of any psychoactive substance that may render them unable to exercise these rights in a safe and appropriate manner;
3) not to carry out any actions related to the risk of using psychoactive substances.
6. Members of the cabin crew of a civil aircraft of the Republic of Kazakhstan must be fluent in the Kazakh language when servicing passengers.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
