Article 242. Legal status of ship's crew members of the Merchant Shipping Act

      1. The legal status of the ship's crew members and the relations between the ship's crew members related to the operation of the ship are determined by the law of the ship's flag country.  

      2. Relations between the shipowner and the ship's crew members are governed by the law of the ship's flag country, unless otherwise provided by an agreement governing relations between the shipowner and the ship's crew members who are foreigners.  

      The choice by the parties to the employment contract of the law to be applied to the employment relationship between the shipowner and the ship's crew members should not lead to restrictions on the rights of the ship's crew members, deterioration of working conditions and violation of guarantees established by the legislation of the country whose law is to be applied in the absence of an agreement between the parties.  

 

The Law of the Republic of Kazakhstan dated January 17, 2002 No. 284.

     This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
