Article 46. Exclusion of an aircraft from the registry The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities
1. An aircraft is excluded from the relevant register of aircraft of the Republic of Kazakhstan in the following cases::
1) decommissioning or decommissioning of an aircraft;
2) sale or transfer of an aircraft to a foreign state, a foreign natural or legal person;
3) registration of a civil aircraft in the Register of State Aviation Aircraft of the Republic of Kazakhstan or the register of foreign states;
4) registration of the state aircraft in the State Register of Civil Aircraft of the Republic of Kazakhstan;
4-1) the absence of a valid certificate of airworthiness for more than two years, the calendar service life of which exceeds forty years from the date of issue of the aircraft, except in cases of encumbrance of property;
5) excluded by the Law of the Republic of Kazakhstan dated 05/10/2017 No. 64-VI (effective ten calendar days after the date of its first official publication);
5-1) the aircraft was declared missing;
6) execution of irrevocable authority.
To exclude an aircraft that is pledged from the State Register of Civil Aircraft of the Republic of Kazakhstan, the consent of the pledgee is required.
2. If an aircraft is excluded from the relevant register, the certificate of registration of the vessel and all entries made in relation to this vessel in the register will become invalid.
3. An authorized organization in the field of civil aviation issues to the aircraft owner a certificate of exclusion of the aircraft from the State Register of Civil Aircraft of the Republic of Kazakhstan.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
