Article 82. Duties of individual entrepreneurs and legal entities to protect the health of employees Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. Individual entrepreneurs and legal entities, in accordance with their activities, are obliged to:
1) to carry out sanitary and anti-epidemic and sanitary-preventive measures;
2) comply with regulatory legal acts in the field of sanitary and epidemiological welfare of the population, as well as acts of officials exercising state control and supervision in the field of sanitary and epidemiological welfare of the population;
3) to ensure the safety and quality of the work performed, services provided and products during their production, transportation, storage and sale to the public, disposal and destruction;
4) to carry out production control in accordance with the requirements provided for in Article 45 of this Code;
5) to inform the state body in the field of sanitary and epidemiological welfare of the population in a timely manner about emergency situations, production shutdowns, violations of technological processes that pose a threat to the sanitary and epidemiological welfare of the population, in cases of mass and group infectious and parasitic, occupational diseases and poisoning;
6) promptly inform the state body in the field of circulation of medicines and medical devices in case of detection of side effects of medicines and medical devices;
7) provide hygienic training for workers belonging to the designated population group;
8) provide officials of the state body in the field of sanitary and epidemiological welfare of the population with the opportunity to take samples of products, raw materials, goods, and the production environment for laboratory research in accordance with their competence;
9) to exclude from work persons who do not have a document certifying the passage of a medical examination, hygienic training, as well as to exclude from work patients with infectious, parasitic diseases and carriers of pathogens of infectious, parasitic diseases, persons with contraindications to work in harmful and (or) dangerous working conditions identified by health care entities, except for infected with HIV infection;
10) to prevent the sale of goods, products, and raw materials if they are found to be inconsistent with regulatory legal acts in the field of sanitary and epidemiological welfare of the population, as well as to decide on the possibility of their use or disposal.;
11) submit accounting and accounting documentation related to the issues of sanitary and epidemiological welfare of the population for verification to the state body in the field of sanitary and epidemiological welfare of the population;
12) suspend business and (or) other activities in case they pose a threat to the life or health of the population;
13) ensure unhindered access of officials exercising state control and supervision in the field of sanitary and epidemiological welfare of the population to facilities in order to check them for compliance with regulatory legal acts in the field of sanitary and epidemiological welfare of the population;
14) at their own expense, carry out disinfection, disinfection and deratization according to epidemiological indications and prescriptions, resolutions of officials of the state body in the field of sanitary and epidemiological welfare of the population;
15) pay deductions and (or) contributions for compulsory social health insurance in accordance with the Law of the Republic of Kazakhstan "On Compulsory Social Health Insurance".
2. The employer creates favorable conditions for health promotion and disease prevention among employees.
