Article 14. State Veterinary and Sanitary Control and Supervision  Chapter 3. State Veterinary and Sanitary Control and Supervision of the Law on Veterinary Medicine

     1. State veterinary and sanitary control and supervision is a set of actions of officials of the authorized body aimed at ensuring compliance by individuals and legal entities with the requirements of the legislation of the Republic of Kazakhstan in the field of veterinary medicine.

     1-1. State veterinary and sanitary control is carried out in the form of inspection, preventive control with a visit to the subject (object) of control and supervision, preventive control without a visit to the subject (object) of control and supervision and investigation.

     State veterinary and sanitary supervision is carried out in accordance with this Law and the Business Code of the Republic of Kazakhstan.

     1-2. Inspection and preventive control with a visit to the subject (object) of control and supervision are carried out in accordance with the Business Code of the Republic of Kazakhstan. Preventive control without visiting the subject (object) of control and supervision is carried out in accordance with the Business Code of the Republic of Kazakhstan and this Law.

     The investigation is carried out in accordance with the Business Code of the Republic of Kazakhstan, this Law and the legislation of the Republic of Kazakhstan in the field of veterinary medicine.

     1-3. State veterinary and sanitary control and supervision over potentially dangerous biological facilities where pathogenic biological agents are handled are carried out taking into account the specifics provided for by the legislation of the Republic of Kazakhstan in the field of biological safety.

     2. State veterinary and sanitary control and supervision provide for:

     1) control and supervision of the activities of individuals and legal entities to comply with the requirements of the legislation of the Republic of Kazakhstan in the field of veterinary medicine;

     2) distribution, control and supervision of the storage, transportation (delivery) and use of veterinary drugs purchased under budget programs, including their national stock;  

     3) control and supervision over the implementation of veterinary measures to protect the territory of the Republic of Kazakhstan from the introduction and spread of infectious and exotic animal diseases from other states;  

     4) maintaining veterinary records and reporting and submitting them in accordance with the procedure established by the legislation of the Republic of Kazakhstan in the field of veterinary medicine;  

     5) control and supervision over the organization and implementation of veterinary measures;

     6) control and supervision of the safety of objects of state veterinary and sanitary control and supervision, veterinary and sanitary conditions; identification and establishment of the causes and conditions of occurrence and spread of animal diseases and their food poisoning;  

     6-1) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);  

     6-2) control and supervision of compliance by the audited entities with the legislation of the Republic of Kazakhstan in the field of veterinary medicine, as well as compliance with the requirements established by technical regulations, including unhindered visits to entities in respect of which they exercise control and supervision with the application of measures provided for by law to violators;

     6-3) control and supervision of the activities of local executive bodies operating in the field of veterinary medicine;

     6-4) control and supervision over the organization and conduct of identification of farm animals, maintaining a database on identification of farm animals and updating information in it;

     7) consideration of cases of administrative offenses in accordance with the legislative acts of the Republic of Kazakhstan.

     2-1. Excluded by the Law of the Republic of Kazakhstan dated 28.10.2019 No. 268-VI (effective ten calendar days after the date of its first official publication).

     3. State veterinary and sanitary control and supervision is carried out by state veterinary and sanitary inspectors who meet the qualification requirements established by the authorized body in accordance with the legislation of the Republic of Kazakhstan.

     3-1. Excluded by the Law of the Republic of Kazakhstan dated 17.07.2009 No. 188-IV (for the procedure of entry into force, see art. 2).

     4. The regulations on state veterinary and sanitary control and supervision are developed and approved by the authorized body.

 

The Law of the Republic of Kazakhstan dated July 10, 2002 No. 339.

This Law defines the legal, organizational and economic basis for carrying out activities in the field of veterinary medicine and is aimed at ensuring veterinary and sanitary safety.
