Article 151. Land management process of the Land Code of the Republic of Kazakhstan

     1. The land management process includes the following stages:  

     initiation of land management activities;  

      preparatory work;  

     development of forecasts, schemes and projects of land management;

      consideration, coordination and approval of land management documentation;  

      execution of the land management project.  

     2. Participants in the land management process are the customer for land management, the developer of land management documentation, third parties whose rights and legitimate interests may be affected during land management, as well as government agencies and other persons who coordinate and approve land management documentation.  

     3. The rights of participants in the land management process:  

     1) the customer for land management has the right:  

     participate personally or through a representative in all stages of the land management process;  

      get acquainted with the materials of the land management industry;  

      submit your proposals for consideration;  

      participate in the resolution of disagreements that have arisen in the process of land management;  

     2) the developer (an individual or a legal entity engaged in design and survey work, as well as carrying out land management projects) has the right:  

     receive the necessary information on land management from government agencies;  

      build relationships with customers on contractual terms;  

      To monitor the progress of land management projects without special permission, inform local executive authorities about its results, and make proposals to improve land use and protection practices.;  

      make suggestions for improving or reworking outdated land management schemes and projects.;  

     3) third parties, whose rights and legitimate interests may be affected during land management, have the right:  

     to participate in the discussion of land management issues and receive information on the progress and results of land management affecting their interests;

      to appeal against illegal actions affecting their interests in the process of land management, in accordance with the legislation of the Republic of Kazakhstan.  

     4. Responsibilities of participants in the land management process:  

     1) all participants in the land management process are obliged to:  

     comply with the land legislation of the Republic of Kazakhstan;  

      comply with the requirements of the competent state authorities on the use and protection of land;  

      to ensure that the rights of land owners and land users are respected in the land management process;  

     2) the executive bodies coordinating and approving the project documentation are obliged to review it within a month.;  

     3) the customer for land management is obliged to:  

     determine the purpose, objectives, content, special conditions and terms of land management;  

      provide the necessary documents and materials;  

      arrange financing of the work;  

      within one month, accept the completed work or issue a reasoned refusal.;  

     4) the developer of the land management documentation is obliged to:  

     perform all work in accordance with the current instructions and guidelines, as well as the contract.;  

      to bring the land plots on which survey, survey and other works were carried out with violation of the soil fertile layer to their original condition;  

     be responsible for the accuracy, quality and environmental safety of the measures provided for in the land management documentation.
