Article 11. Correction factors to the basic rates of payment for land plots of the Land Code of the Republic of Kazakhstan

Article 11. Correction factors to the basic rates of payment for land plots of the Land Code of the Republic of Kazakhstan

     1. The boundaries of the assessment zones and correction coefficients to the base rates of payment for land plots in cities of regional significance, towns and rural settlements are approved by the decision of the district representative body on the proposal of the local executive body of the district, and in cities of regional significance, cities of republican significance, the capital - by the representative body of the region, the city of republican significance, the capital on the proposal of the local executive body of the region, the city of republican significance, the capital.  

     In this case, the maximum size of the increasing or decreasing coefficient should not exceed two times the size.  

     2. When determining the cadastral (estimated) value of land plots provided by the state for agricultural production, correction factors (increasing or decreasing) are applied depending on the quality of the land plot, its location, water availability, and distance from service centers.  

     3. The qualitative condition of the land plot according to the types of lands and types of soils is established on the basis of land cadastral maps, materials of soil, geobotanical, soil-reclamation and other surveys.:  

     1) the following correction factors are used to determine the value of a land plot used as part of arable land, depending on its reclamation condition and the slope of the surface:  

     land reclamation status:  

     good (unsalted and non-saline, non-calcified, non-eroded soils; depth of groundwater: fresh - more than 3 m, mineralized - more than 6 m) - 1.2;  

     satisfactory (slightly saline, slightly saline, slightly stony, slightly eroded soils; depth of slightly mineralized groundwater 3-6 m) - 0.9;  

     unsatisfactory (medium- and highly saline, medium- and highly saline, rocky, medium- and highly eroded soils; groundwater depth with a mineralization of more than 1 g/l - less than 3 m) - 0.6;  

     surface slope:  

     up to 1 degree - 1; from 1 to 3 degrees - 0.98; from 3 to 5 degrees - 0.96; from 5 to 7 degrees - 0.93; more than 7 degrees - 0.86;  

     2) the following correction factors are applied to determine the value of land plots used as part of natural forage lands (hayfields, pastures), depending on their quality condition and the slope of the site surface:  

     improved hayfields and pastures:  

     radical improvement; with sowing of perennial grasses - 1.2;  

     surface improvement without changing the species composition of vegetation cover - 1.1;  

     the condition of the lands occupied by hayfields:  

     good (the land plot is uninhabited, uncultivated, not wooded, not shaded with well-defined signs of zonal vegetation) - 1,2;  

     satisfactory (the land plot is clogged, overgrown, wooded, rocky with violations of the zonal structure of vegetation cover. These signs appear on an area of up to 40 percent of the territory) - 0.9;  

     unsatisfactory (the land plot is clogged, overgrown, wooded, rocky with violations of the zonal structure of vegetation cover. These signs appear on an area of over 40 percent of the territory) - 0.7;  

     surface slope:  

     up to 3 degrees - 1; from 3.1 to 6 degrees - 0.95; from 6.1 to 10 degrees - 0.9; from 10.1 to 20 degrees - 0.85; more than 20 degrees - 0.5;

     the condition of the lands occupied by pastures:  

     good (the land plot is uninhabited, uncultivated (not eaten by shrubs), not wooded, not shaded with well-defined signs of zonal vegetation) - 1,2;  

     satisfactory (the land plot is clogged, overgrown (with non-edible shrubs), wooded, rocky with violations of the zonal structure of vegetation cover, the presence of heavily beaten pastures, bare salt marshes, salt marshes, takyrs. These signs appear on an area of up to 40 percent of the territory) - 0.9;  

     unsatisfactory (the land plot is clogged, overgrown (with non-edible shrubs), wooded, rocky with violations of the zonal structure of vegetation cover, the presence of heavily beaten pastures, bare salt marshes, salt marshes, takyrs. These signs appear on an area of more than 40 percent of the territory) - 0.6;  

     surface slope:  

     up to 12 degrees - 1; from 13 to 20 degrees - 0.8; over 20 degrees - 0.6.  

     4. The following correction factors are used to determine the value of land plots depending on the water availability of the land plot, its location in relation to the economic center, and the distance of the land plot from service centers:  

     1) water availability (water availability) of the land plot:  

     watered - 1.2; non-watered - 0.8;  

     2) the location of the land plot in relation to the economic center, in kilometers:  

     up to five - 1.2; from 5 to 10 - 1; from 10 to 20 - 0.9; from 20 to 30 - 0.8; over 30 - 0.7;  

     3) the distance of the land plot from the service centers, depending on the quality of the roads:

     5. If there are several factors that increase or decrease the cadastral (estimated) value of a land plot, the coefficients are multiplied.  

     The total amount of increase or decrease in the cadastral (estimated) value of a land plot for agricultural production should not exceed fifty percent of the base payment rates established in accordance with paragraph 1 of Article 10 of this Code.
