Article 12. A document confirming the state (accounting) registration (re-registration) of a legal entity, branch (representative office) of the Law on State Registration of Legal Entities and Registration of Branches and Representative Offices

     The document confirming the state registration (re-registration) of a legal entity and the registration (re-registration) of a branch (representative office) is a certificate in the form established by the Ministry of Justice of the Republic of Kazakhstan.

     The certificate of state registration (re-registration) of a legal entity contains information about the date of its issuance, the registering authority, the business identification number, the date of state registration (re-registration), the name and location of the legal entity, the heads and founders (participants). If a legal entity belonging to a private business entity carries out its activities on the basis of a standard charter, then information about this is displayed in the specified certificate.

     The certificate of registration (re-registration) of a branch (representative office) contains information about the date of its issuance, the registering authority, the business identification number, the date of registration (re-registration), the name and location of the branch (representative office), the name of the legal entity that established the branch (representative office).

     The presence of a document confirming the state (accounting) registration (re-registration) of a legal entity, as well as a branch of a foreign legal entity, the subject of which is the provision of financial services, is not a reason for starting an activity requiring a license in accordance with the laws of the Republic of Kazakhstan. The legal capacity of a legal entity, as well as a branch of a foreign legal entity whose business is the provision of financial services, in the field of licensed activities arises from the moment the relevant license is obtained and is terminated from the moment the license is terminated or invalidated in accordance with the procedure established by the laws of the Republic of Kazakhstan.
