On signing an Agreement on measures aimed at unifying the conduct of breeding and breeding work with farm animals within the framework of the Eurasian Economic Union

Decree of the President of the Republic of Kazakhstan dated October 24, 2019 No. 192.

 In accordance with Article 8 of the Law of the Republic of Kazakhstan dated May 30, 2005 "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE:

     1. To approve the attached draft Agreement on measures aimed at unifying the conduct of breeding and breeding work with farm animals within the framework of the Eurasian Economic Union (hereinafter referred to as the Agreement).

     2. To authorize the Prime Minister of the Republic of Kazakhstan, Mamin Askar Uzakpaevich, to sign an Agreement on behalf of the Republic of Kazakhstan, authorizing amendments and additions that are not of a fundamental nature.

     3. This Decree shall enter into force from the date of its signing.

Agreements on measures aimed at unifying the conduct of breeding and breeding work with farm animals within the framework of the Eurasian Economic Union

     The Member States of the Eurasian Economic Union, hereinafter referred to as the Member States,

     based on the provisions of section XXV of the Treaty on the Eurasian Economic Union of May 29, 2014,

     striving to increase the production of competitive agricultural products,

     considering that the productivity of farm animals largely depends on the use of breeding animals,

     have agreed on the following:

Article 1

     This Agreement has been developed in order to implement a coordinated (coordinated) agro-industrial policy and regulates the conduct of breeding and breeding work with farm animals in the Member States.

     Breeding and breeding work with farm animals in the territories of the Member States is carried out subject to the provisions of this Agreement.

Article 2

     For the purposes of this Agreement, concepts are used that mean the following::

     "breeding products" - a breeding animal, its seed, embryos, larvae, bee packages;

     "breeding value" is the level of breeding characteristics of a breeding animal, a breeding herd and the possibility of their transmission to offspring.;

     "breeding animal" means an agricultural animal used for breeding, registered in the register of breeding animals in accordance with the procedure established by the legislation of a Member State in the field of livestock breeding and having, in case of its sale, a breeding certificate (certificate, passport);

     "breeding and breeding work" is a set of measures aimed at improving the breeding and productive qualities of farm animals;

     "farm animals" are animals bred for the production of livestock and other agricultural products.

Article 3

     In order to apply uniform requirements in the field of production of breeding products in the Member States, the Member States, when carrying out breeding work, shall, in accordance with this Agreement, standardize the testing of new types, lines (breeds) and crosses of farm animals, conduct a molecular genetic examination of breeding products, and determine the breed of breeding animals obtained by using related breeds, as well as estimates of breeding value.

     The procedure for testing new types, lines (breeds) and crosses of farm animals, the procedure for conducting a molecular genetic examination of breeding products, the procedure for determining the breed of breeding animals obtained using related breeds, as well as methods for assessing breeding value are approved by the Eurasian Economic Commission (hereinafter referred to as the Commission).

Article 4

     Coordination and analytical support of breeding and breeding work in the field of livestock breeding carried out in the Member States in order to develop and implement innovative technologies in the Member States, including genomic breeding, shall be carried out in accordance with the procedure established by the Eurasian Intergovernmental Council, on the basis of existing institutions of the Member States, determined by the Eurasian Intergovernmental Council.

Article 5

     The Member States shall ensure the exchange of information on breeding animals and breeding achievements, including in electronic form.

     The composition of the information to be exchanged and the procedure for such exchange are approved by the Commission.

Article 6

     Prior to the entry into force of the Commission's acts approving the procedures and methods provided for in Article 3 of this Agreement, the relevant procedures and methods provided for by the legislation of the Member States shall be applied in the Member States.

Article 7

     This Agreement is an international agreement concluded within the framework of the Eurasian Economic Union and is included in the law of the Eurasian Economic Union.

Article 8

     Disputes related to the application of this Agreement are resolved in accordance with the procedure established by the Treaty on the Eurasian Economic Union of May 29, 2014.

Article 9

     By mutual agreement of the Member States, amendments and additions may be made to this Agreement, which are formalized in separate protocols and are an integral part of this Agreement.

Article 10

     This Agreement shall enter into force upon the expiration of 30 calendar days from the date of receipt by the depositary through diplomatic channels of the last written notification on the completion by the Member States of the internal procedures necessary for the entry into force of this Agreement.

     Committed in the city ______"____"________ 201___ year in one original copy in Russian.

     The original copy of this Agreement shall be kept at the Eurasian Economic Commission, which, as the depositary of this Agreement, will send each member State a certified copy thereof.
