Decree of the President of the Republic of Kazakhstan dated April 13, 2000 No. 371.

In order to ensure a unified policy in the field of protection of state secrets in accordance with subparagraph 4) of Article 5 of the Law of the Republic of Kazakhstan "On State Secrets", I HEREBY DECREE:

The footnote. The preamble is in the wording of the Decree of the President of the Republic of Kazakhstan dated 02/28/2024 No. 488.

1. To approve the attached List of government officials authorized to classify information as state secrets of the Republic of Kazakhstan (hereinafter referred to as the List).

2. To empower officials of the state bodies indicated in the List with the authority to classify information of an industry (departmental) affiliation as state secrets of the Republic of Kazakhstan within its competence, as defined by the regulations on a specific state body, as well as information of a relevant thematic focus of other state bodies upon their submission.

3. To determine that officials of state bodies authorized to classify information as state secrets are personally responsible for the validity of their decisions on classifying specific information as state secrets and the timely declassification of this information.

4. This Decree comes into force from the date of signing.

LIST of government officials authorized to classify information as state secrets of the Republic of Kazakhstan

General provisions

1. The list of government officials authorized to classify information as state secrets of the Republic of Kazakhstan (hereinafter referred to as the List) has been developed in accordance with subparagraph 4) of Article 5 of the Law of the Republic of Kazakhstan "On State Secrets" and subparagraph 214) of paragraph 15 of the Regulations on the National Security Committee of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated 1 April 1996, No. 2922.

2. The Head of the Presidential Administration of the Republic of Kazakhstan and the Chief of Staff of the Government of the Republic of Kazakhstan are authorized to classify all information defined in Articles 11, 12, 13 and 14 of the Law of the Republic of Kazakhstan "On State Secrets" as state secrets of the Republic of Kazakhstan.

The Head of the Presidential Administration of the Republic of Kazakhstan and the Chief of Staff of the Government of the Republic of Kazakhstan approve their departmental lists of information subject to secrecy, in coordination with the authorized state body for the protection of state secrets of the Republic of Kazakhstan.

3. The first heads of state bodies are authorized to classify information as state secrets on the basis of Articles 11, 12, 13 and 14 of the Law of the Republic of Kazakhstan "On State Secrets".:

4. The first heads of newly formed and (or) reorganized state bodies of the Republic of Kazakhstan shall take measures to introduce amendments and additions to the List, as well as to develop, process and approve departmental lists of information subject to secrecy in accordance with their sectoral, departmental or program-target affiliation, in coordination with the authorized state body for the protection of state secrets of the Republic of Kazakhstan.
