Article 252. Abuse of authority by the head or employee of a private security organization, collection agency of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1. Exceeding by the head or employee of a private security organization the powers granted to them in accordance with the license, as well as exceeding by an employee of a collection agency interacting with the debtor and (or) his representative, and (or) a third person, the powers provided for by the legislation of the Republic of Kazakhstan on collection activities, contrary to the objectives of his activity, if this act is committed with the use of violence or the threat of its use, the threat of destruction or damage to property, forgery of documents, blackmail, –
is punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same term, with deprivation of the right to hold certain positions or engage in certain activities for a period of up to five years or without it.
2. The same act committed with the use of weapons or special means or causing grave consequences, –
is punishable by imprisonment for a term of three to eight years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to five years.
