1. In accordance with this Law, copyright applies:

1) works published on the territory of the Republic of Kazakhstan or unpublished, but located in any objective form on the territory of the Republic of Kazakhstan, regardless of the nationality of the authors and their legal successors;

2) works published outside the Republic of Kazakhstan or unpublished, but located in some objective form outside the Republic of Kazakhstan, and recognized for the authors - citizens of the Republic of Kazakhstan and their legal successors;

3) works published outside the Republic of Kazakhstan or unpublished, but located in some objective form outside the Republic of Kazakhstan, and recognized for the authors (their legal successors) - foreigners, stateless persons in accordance with international treaties ratified by the Republic of Kazakhstan.

2. A work is considered published in the Republic of Kazakhstan if it has been published in the territory of the Republic of Kazakhstan within thirty days after the date of the first publication outside the Republic of Kazakhstan.

3. When granting protection to a work in the territory of the Republic of Kazakhstan in accordance with international treaties, the author of the work is determined by the law of the state where the action or circumstance that served as the basis for the possession of copyright took place.

4. Protection for a work in accordance with international treaties ratified by the Republic of Kazakhstan is granted if it has not passed into the public domain in the country of origin of the work, determined according to the rules of the relevant international treaty ratified by the Republic of Kazakhstan, as a result of the expiration of the copyright term established in such country and has not passed into the public domain in the Republic of Kazakhstan as a result of the expiration of the copyright term established in such country. the validity period of the copyright.
