Article 15. Personal non-property rights of the Copyright and Related Rights Act
1. The author has the following personal non-property rights in relation to his work::
1) the right to be recognized as the author of a work and to demand such recognition, including by properly indicating the author's name on copies of the work and in any public use, if practicable (the right of authorship);
2) the right to indicate and require an indication on copies of the work and in any public use, instead of the author's real name, his fictitious name (pseudonym) or to refuse to indicate the name, that is, anonymously (the right to a name);
3) the right to inviolability of the work, including its title, the right to resist any perversion, distortion or other modification of the work, as well as any other encroachment that could damage the honor or reputation of the author (the right to protect the reputation of the author);
4) the right to open access to a work to an indefinite circle of persons (the right to make it public), with the exception of works created in the course of fulfilling official duties or official assignments of the employer.
2. The author has the right to waive an earlier decision to publish the work (the right to recall), provided that the user is compensated for the losses caused by such a decision, including lost profits. If the work has already been published, the author is obliged to publicly notify about its withdrawal. At the same time, he has the right to withdraw previously produced copies of the work from circulation at his own expense.
The provisions of this paragraph shall not apply to the creation of official works.
3. Personal non-property rights belong to the author, regardless of his property rights, and are reserved for him in case of assignment of the exclusive rights to use the work.
4. The personal non-property rights of the author provided for in this article are inalienable.
5. The exercise of personal non-property rights after the death of the author is carried out in accordance with the procedure established in Article 30 of this Law.
