Comment to Article 117. Acceptance of donations by a candidate for elected public office or a political party from foreign states, organizations, foreigners and stateless persons The Code of the Republic of Kazakhstan on Administrative Offences
Accepting donations in any form from a foreign state, an international organization or an international public association, foreign government agencies, foreigners and legal entities established in accordance with the legislation of another state, as well as stateless persons, by a candidate for deputy or for another elected public position or by a political party –
entails a fine for a candidate for deputy or for another elected position in the amount of fifty, for a legal entity – in the amount of one hundred monthly calculation indices, with confiscation of donation items.
In paragraph 3 of art . 12 Conventions on Standards of Democratic Elections, Electoral Rights and Freedoms in States - members of the Commonwealth of Independent States (Chisinau, October 7, 2002) stated that "any foreign donations, including from foreign individuals and legal entities, to candidates, political parties (coalitions) participating in elections, or other public associations, public organizations that directly or indirectly, or otherwise They belong to a candidate, a political party (coalition), or are under their direct influence or control and contribute to or contribute to the realization of the goals of a political party (coalition), are not allowed."
In accordance with paragraph 15) of paragraph 2 of T. 50 of the Constitutional Law "On Elections in the Republic of Kazakhstan", a person bears administrative and other responsibility established by the law of the Republic of Kazakhstan in case of accepting donations from foreign states, organizations, citizens, and stateless persons for the election of a candidate.
Paragraph 3 of Article 33 of the Constitutional Law stipulates that the financing of elections in the Republic by international organizations and international public associations, foreign government agencies, foreign legal entities and citizens, as well as stateless persons, any direct or indirect participation in the financing of elections in the Republic is prohibited.
Foreigners, stateless persons, foreign legal entities, and international organizations are prohibited from carrying out activities that hinder and/or facilitate the nomination and election of candidates, political parties that have nominated a party list, and the achievement of a certain election result.

According to Article 2 of the Law of the Republic of Kazakhstan dated June 19, 1995 No. 2337 "On the legal status of foreigners", "foreigners in the Republic of Kazakhstan are persons who are not citizens of the Republic of Kazakhstan and have proof of their citizenship of another state. Persons who are not citizens of the Republic of Kazakhstan and do not have proof of their citizenship of another state are recognized as stateless persons."
The general object of the offense is the established procedure for financing the electoral process. The generic object of this offense is the social and legal relations that arise when observing the procedure for financing the electoral process.
The objective side of this offense is expressed in actions to accept donations in any form from a foreign state, an international organization or an international public association, foreign government agencies, foreigners and legal entities established in accordance with the legislation of another state, as well as stateless persons, by a candidate for deputy or for another elected public office or by a political party.
The subjective side is expressed in the fact that this offense is committed intentionally.
The subject of this offense is a special one - these are candidates for deputies or for another elected public office or political parties.
In accordance with Part 1 of Article 805 of the Administrative Code, administrative offenses provided for in Article 117 of the Administrative Code relate to cases in which the prosecutor issues a decision to institute proceedings on administrative offenses.
According to Part 1 of Article 684 of the Administrative Code, cases of administrative offenses provided for in Article 117 of the Administrative Code are considered by judges of specialized district and equivalent administrative courts.
At the same time, a protocol on an administrative offense is not drawn up when individuals apply for restoration of violated rights under Article 117 of the Administrative Code. In this case, the case is considered by the court without drawing up a protocol on the offense (paragraph 4) of Part 1 of Article 807 of the Administrative Code).
