Article 42. Creation, reorganization and liquidation of educational organizations The Law on Education
1. The establishment, reorganization, liquidation and termination of educational organizations, including the establishment, reorganization, liquidation and termination of activities by organizations of higher and (or) postgraduate education of legal entities in scientific and educational activities, shall be carried out in accordance with the legislation of the Republic of Kazakhstan.
The reorganization of organizations of higher and (or) postgraduate education established as commercial organizations into non-profit organizations is carried out in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Non-Profit Organizations".
2. In case of revocation of the license to engage in educational activities, liquidation or termination of the educational organization, its founder(s) shall take measures to transfer students to continue their studies in other educational organizations.
The requirements of the first part of this paragraph do not apply to organizations of higher and (or) postgraduate education.
3. In cases of deprivation (revocation), termination of the license and (or) the appendix to the license to engage in educational activities, liquidation or termination of the organization of higher and (or) postgraduate education, its founder (s) within two months from the date of the decision to revoke (revoke), termination of the license and (or) appendices to the license provide:
1) transfer of students to continue their studies and transfer of their personal files to other organizations of higher and (or) postgraduate education;
2) transfer of personal files of persons who have not completed their education or have not passed the final certification, as well as personal files and copies of educational documents of persons who have completed their studies at an educational organization in previous years, to the appropriate state archive.
4. The establishment and termination of branches of foreign organizations of higher and (or) postgraduate education and foreign educational institutions that comply with the recognition rules are carried out on the basis of international treaties of the Republic of Kazakhstan or by decision of the authorized body in the field of science and higher education in accordance with the legislation of the Republic of Kazakhstan.
5. The establishment and termination of activities of international educational institutions in the Republic of Kazakhstan and (or) their branches are carried out on the basis of international treaties of the Republic of Kazakhstan or by decision of the authorized body in the field of science and higher education in accordance with the legislation of the Republic of Kazakhstan.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
