Article 349. Admission to driving of a driver who does not have the right to drive the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 The admission by an official or the owner or owner of a vehicle to drive a vehicle of a driver who does not have the right to drive vehicles or the right to drive vehicles of the appropriate category, if this act negligently caused moderate harm to human health, –

     is punishable by a fine in the amount of up to two hundred monthly calculation indices, or correctional labor in the same amount, or community service for up to two hundred hours, or arrest for up to fifty days.

2 The same act that negligently caused serious harm to human health, –

     is punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to six hundred hours, or restriction of liberty for up to two years, or imprisonment for the same term, with deprivation of the right to hold certain positions or engage in certain activities for up to three years. years old or not.

3 The act provided for in the first part of this Article, which negligently caused the death of a person, –

     is punishable by imprisonment for a term of up to three years with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

4 The act provided for in the first part of this Article, which negligently caused the death of two or more persons, –

     is punishable by imprisonment for a term of up to five years with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
