Article 346. Driving a vehicle by a person deprived of the right to drive vehicles and being in a state of alcoholic, narcotic and (or) substance abuse intoxication, as well as transferring control of a vehicle to such a person or allowing such a person to drive a vehicle of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

Article 346. Driving a vehicle by a person deprived of the right to drive vehicles and being in a state of alcoholic, narcotic and (or) substance abuse intoxication, as well as transferring control of a vehicle to such a person or allowing such a person to drive a vehicle of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Driving a vehicle by a person deprived of the right to drive vehicles and being in a state of alcoholic, narcotic and (or) substance abuse intoxication, or transferring control of a vehicle to such a person, as well as allowing such a person to drive a vehicle, committed by an official or the owner or owner of the vehicle, –

     are punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same term, with life imprisonment for the right to hold certain positions or engage in certain activities.

2 The actions provided for in the first part of this Article that negligently caused damage to vehicles, goods, road and other structures or other property, as well as causing minor harm to human health, –

     are punishable by imprisonment for a term of four to six years with life imprisonment for the right to hold certain positions or engage in certain activities.

3 The same acts that negligently caused moderate harm to human health, –

     are punishable by imprisonment for a term of five to seven years with life imprisonment for the right to hold certain positions or engage in certain activities.

4 The acts provided for in the first part of this Article, which negligently caused serious harm to human health, –

     are punishable by imprisonment for a term of six to eight years with life imprisonment for the right to hold certain positions or engage in certain activities.

5 The acts provided for in the first part of this Article that negligently caused the death of a person, –

     are punishable by imprisonment for a term of seven to nine years with life imprisonment for the right to hold certain positions or engage in certain activities.

6 The acts provided for in the first part of this Article that negligently caused the death of two or more persons, –

     are punishable by imprisonment for a term of eight to ten years with life imprisonment for the right to hold certain positions or engage in certain activities.
