Article 28. Protection and protection of communications facilities, facilities and communication networks, radio frequency spectrum and orbital positions of communications satellites of the Communications Act

1. Telecommunications networks and facilities, the radio frequency spectrum and the orbital positions of communications satellites are protected by the State.

2. The protection of communications facilities, facilities and communication networks, the radio frequency spectrum, and the orbital positions of communications satellites is established in accordance with the legislation of the Republic of Kazakhstan.

3. In order to protect the established procedure for the use of the radio frequency spectrum and the orbital positions of communication satellites, the legislation of the Republic of Kazakhstan may impose restrictions on the production and import into the Republic of Kazakhstan, as well as the operation of electronic communications equipment that create abnormal interference with the functioning of electromagnetic systems.

4. Individuals and legal entities who have damaged communications facilities, structures and telecommunications networks, violated the established procedure for manufacturing, purchasing, importing, using radio-electronic equipment and high-frequency devices, using radio frequencies for the operation of radio-electronic equipment of all purposes and high-frequency devices, as well as creating abnormal interference to television and radio reception, are liable in accordance with the laws of the Republic of Kazakhstan..

This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
