LEASE AGREEMENT NO.__________

 

B. L. Talgatovna, hereinafter referred to as the Lessor, on the one hand and ____________________________________________________, hereinafter referred to as the Lessee, on the other hand, hereinafter referred to collectively as the "Parties" and separately as the "Party", have entered into this Lease Agreement (hereinafter referred to as the Agreement) as follows.

1.                  Subject of the agreement

1.1          The Lessor transfers for temporary use on lease (hereinafter referred to as Lease) to the Tenant a dwelling (hereinafter referred to as Apartment) with a total area of 50 square meters.m, consisting of 2 (two) living rooms, located at the address: Almaty oblysy, Karasai audany, Kaskelen Kalasi, Zhangozin koshesi, house 61 B, Building 4, apartment 10 of the Kemel residential complex belongs to the Landlord by right of ownership, which is confirmed by a certificate from the electronic government portal on the date of conclusion of the contract.

1.2          The Tenant accepts for temporary use on a lease basis for the purpose of accommodating a physical person(s) (hereinafter referred to as Tenants), indicated by the Tenant, for his (their) residence in the Apartment and pays the rent for the Apartment, in accordance with clauses 3.1 and 3.2 of this The agreement.

1.3          The Landlord guarantees that the leased Apartment belongs to the Landlord by right of ownership.

1.4          The Apartment transferred to the Tenant will be used exclusively as a living space for living.

2. Rights and obligations of the parties

2.1          The landlord is obliged to:

2.1.1      Promptly, no later than 3 (three) days from the date of conclusion of this Agreement, as well as the tenant's deposit and payment of rent for the first month, transfer the apartment to the tenant for Tenants to move in.

2.1.2      To transfer the Apartment in proper condition, suitable for use in accordance with the terms of this Agreement.

2.1.3      Eliminate accidents and damages caused by no fault of the Tenant and/or Tenants.

2.1.4      Repair damages (including damage to third parties) and carry out ongoing repairs of the Apartment at their own expense in case of malfunctions and emergencies caused by no fault of the Tenant and/or Tenants.

2.1.5      Notify the Tenant and Tenants, in case of checking the condition of the apartment, no later than 2 calendar days.

2.2          The Lessor has the right to:

2.2.1 Require the Tenant to pay the rent and the guarantee fee on time in accordance with the terms of this Agreement.

2.2.2 To check the condition of the Rented Apartment, the conditions of its maintenance and its intended use at the time and time agreed in advance with the Tenant and Tenants.

2.2.3 Terminate this Agreement unilaterally in case of violation by the Lessee of the Conditions of this Agreement for timely payment of rent and proper maintenance of the Apartment, damage to the apartment and property, having previously notified the Lessee 10 (ten) days before the date of the expected termination of the Agreement.

2.2.4 In case of emergency situations in the Apartment's communications system, water supply, sewerage, electricity, etc., which may cause damage to third parties, enter the Facility to eliminate these situations without notifying the Tenant and Tenants.

2.2.5    To check the condition of the apartment, at the time agreed with the Tenant and Tenants, no more than twice a month.

2.3          The tenant is obliged to:

2.3.1 Use the Apartment in accordance with the conditions specified in clause 1.4 of this Agreement.

2.3.2      To keep the property in good condition, in compliance with sanitary and fire safety standards provided for by the legislation of the Republic of Kazakhstan, to observe silence and order, not to violate the rules of living in an apartment building.

2.3.3      Repair damages and perform routine repairs of the Apartment at your own expense in case of malfunctions and emergencies caused by the fault of the Tenant.

2.3.4      Timely pay for utilities: water supply, sewerage, electricity, telephone and cable TV on bills issued by the relevant services.

2.3.5      Within the time limits set by the Contract, make payments on rent in accordance with the conditions specified in clauses 3.1, 3.2.

2.3.6 Not to sublet or otherwise use the Apartment to third parties.

2.3.7      The Lessee is obliged to notify the Lessor of the early termination of the Contract no later than 10 (ten) days in advance.

2.3.8      The tenant undertakes to live in the rented apartment for no more than 2 people and not to have pets.

2.3.9      The rented apartment will be occupied by:

2.4          The tenant has the right to:

2.4.1 Terminate this Agreement unilaterally by notifying the Tenant 10 (ten) days prior to the date of the expected termination of the Agreement without refund of the deposit.

3. Lease payments and settlement procedure

3.1 The amount of the rent is _____________________ (________________________________________________) tenge per month;

3.2          The rent is paid by the Tenant on a monthly basis as an advance payment no later than the ______ day of the current month;

3.3          If the Tenant vacates the Apartment earlier than the time stipulated in the Contract on the initiative of either Party, the payment already made for the remaining unused part of the time is not subject to refund to the Tenant.

4. The term of the contract and the guarantee fee

4.1 The lease agreement is concluded for the period from "__" ___________ 202___ year by "___" __________ 202___ a year with a preferential right of prolongation by mutual agreement of the parties.

4.2          The Lessee guarantees, no later than 5 (five) calendar days from the date of signing this Agreement, to pay the Lessor a Guarantee Fee in the amount of the rent for 1 (one) month (hereinafter referred to as the Guarantee Fee), which amounts to _________________ (______________________________________) tenge. The Guarantee Fee is to ensure that the Tenant performs his duties properly.

4.3 The term of the Guarantee Fee is for the entire period of validity of this Agreement.

4.4          The Lessee confirms to the Lessor his unconditional consent to withhold the corresponding part of the amount of the Guarantee Fee in the following cases:

• The tenant caused material damage. In case of causing any losses to the Lessor, the Lessee compensates the damage to the Lessee in accordance with clause 8.;

4.5 The Guarantee Fee is refunded to the Lessee within 3 (three) business days after all settlements between the Parties have been completed in the following cases::

• Termination of this Agreement as in connection with the expiration of its term.

4.6 The guarantee fee is not refunded to the Lessee in case of early termination of the contract at the initiative of the Lessee.

5. Dispute resolution procedure

5.1          All disputes arising between the parties under this Lease Agreement are resolved through negotiations.

5.2          In case of failure to reach an agreement, disputes are resolved in the judicial authorities of the city of Almaty, in accordance with the current legislation of the Republic of Kazakhstan.

6. Transfer of premises

6.1          The Apartment is transferred by the Landlord to the Tenant in a condition suitable for its operation according to its intended purpose, from the moment of signing this Agreement according to the Act of Acceptance and Transfer (Appendix No. 1 to this Agreement), signed by both Parties, which is an integral part of this Agreement.

6.2          The return of the Premises is made by the Tenant to the Landlord according to the Act of Acceptance and transfer within 5 (five) business days from the date of termination of the Contract in the condition in which it was received by the Tenant, taking into account the natural depreciation of the property.

7. Other conditions

7.1 This Agreement is concluded in Russian in 2 (two) identical copies, one copy for each of the Parties.;

7.2          The Lessor does not have the right to enter the rented premises without prior notice to the Lessee, except in the cases specified in clause 2.2.4.

 

8. List of the property included in the Apartment
