Article 150. Artificial termination of pregnancy Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

Article 150. Artificial termination of pregnancy Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

     1. A woman has the right to an artificial termination of pregnancy.

     2. Artificial termination of pregnancy at the request of a woman is carried out with a pregnancy period of up to twelve weeks.

     In order to prevent artificial termination of pregnancy, doctors are required to conduct conversations aimed at clarifying the moral, ethical, psychological and negative physiological consequences and possible complications.

     3. Artificial termination of pregnancy for social reasons is performed when the pregnancy is up to twenty-two weeks old, and in the presence of medical indications and conditions that threaten the life of the pregnant woman and (or) the fetus (in the presence of monogenic genetic diseases, uncorrectable congenital malformations and fetal conditions incompatible with life), regardless of the duration of pregnancy.

     4. Artificial termination of pregnancy for minors is performed with the consent of their parents or other legal representatives.

     5. Artificial termination of pregnancy in an adult recognized as legally incompetent, if she is unable to express her will due to her condition, is possible by a court decision taken at the request of her legal representative and with the participation of an adult recognized as legally incompetent.

     6. At the request of a woman, medical and social counseling is provided in medical organizations before and after artificial termination of pregnancy, including individual selection of methods and means of contraception.

     7. The procedure, list of medical and social indications, as well as contraindications for artificial termination of pregnancy are determined by the authorized body.
