Article 1108. The emergence and termination of property rights of the Civil Code of the Republic of Kazakhstan
1. The emergence and termination of real rights to property are determined by the law of the country where this property was located at the time when the action or other circumstance that served as the basis for the emergence or termination of real rights took place, unless otherwise provided by legislative acts of the Republic of Kazakhstan.
2. The emergence and termination of property rights to the property that is the subject of the transaction is determined by the law of the country to which the transaction is subject, unless otherwise established by agreement of the parties.
3. The emergence of ownership of property as a result of the statute of limitations is determined by the law of the country where the property was located at the time of the expiration of the statute of limitations.
