Requirement

          By the verdict of the Specialized Interdistrict court for criminal cases of Almaty region dated January 11, 2024, paragraphs 1), 3) of Part 2 of Article 191 of the Criminal Code of the Republic of Kazakhstan, paragraph 1) of Part 3 of Article 122 of the criminal code, on the basis of Part 3 of Article 58 of the criminal code, the final sentence is sentenced to 12 years of imprisonment and serving the sentence in medium-safe institutions of the Penal correction system.

          By the decision of the Judicial Board of the Almaty regional court for criminal cases dated February 27, 2024, the above sentence was left unchanged.

However, on August 20, 2024, the judicial board for criminal cases of the Supreme Court of the Republic of Kazakhstan reviewed the criminal case No. 2up-302-24 and decided:

Amend the verdict of the specialized Inter-District Court for criminal cases of the Almaty region dated January 11, 2024 and the resolution of the judicial board for criminal cases of the Almaty Regional Court dated February 27, 2024 in relation to A. M. A.

To cancel judicial acts in respect of A. M. A. in accordance with paragraph 1) of Part 3 of Article 122 of the criminal code.

Submit the criminal case to the court of Appeal for new judicial consideration.

I believe that today A. M. A. is being held in the penitentiary system of the East Kazakhstan region without a criminal record, because he is due to the return of a re-convict from among those who have been convicted.

Taking into account the above arguments, I demand from the Appellate Judicial Board for criminal cases of Almaty region:

* Transfer A. M. A. from the penitentiary system of the East Kazakhstan region to the city of Almaty and participate in the upcoming court sessions offline;

* Cancel the preventive measure in the form of detention and replace it with a preventive measure in the form of "house arrest".
