The petition
In your case, a criminal case No. 7598-24-00-1/57 was considered in relation to M. M. full name dated 09.05.1984, filed under Article 346, part 5, Article 347 of the Criminal Code of the Republic of Kazakhstan (hereinafter referred to as the Criminal Code).
On May 13, 2024, the specialized Inter-District Court for criminal cases of Almaty found A. zh.m.guilty of committing an offense provided for by Article 346, part 5, Article 347 of the Criminal Code of the Republic of Kazakhstan, to which, in accordance with Part 3 of Article 58 of the Criminal Code of the Republic of Kazakhstan, A. zh. m.was sentenced to 7 years of imprisonment with a life deprivation of the right to drive a vehicle.
During the announcement of the sentence, the court declared that the request to recover the costs of 500,000 tenge paid for the assistance of the representative in favor of the defendant zh. M.A., the victim zh.K. Sh., specified in the civil claim, should be collected in full.
But nothing was written about the recovery of the expenses incurred by the representatives specified in the verdict of the court of transfer.
In accordance with article 406-1 of the Criminal Procedure Code of the Republic of Kazakhstan, before the entry into force of the sentence or decision, the court, without changing their essence, has the right to make an additional decision on correcting obvious errors made and clarifying unclear points in them, on material evidence, the fate of which has not been decided by a court verdict or decision, on correcting technical and arithmetic errors in resolving a civil claim, as well as on the amount of procedural costs, compulsory payment to the Victim Compensation Fund and state duty in case of their incorrect calculation.
In accordance with article 406-1 of the Criminal Procedure Code of the Republic of Kazakhstan,

On May 13, 2024, an additional resolution was issued against the verdict of the specialized interdistrict criminal court of Almaty to the victim Zh. K. Sh. on full satisfaction of the civil claim regarding the recovery of damages paid to the representative, recovery in favor of A. Zh. M. Zh. K. Sh. in the amount of 500,000 (five hundred thousand) tenge or a verdict was passed. please add an additional paragraph.
