Article 96. Extension, modification and termination of the use of compulsory medical measures of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

Article 96. Extension, modification and termination of the use of compulsory medical measures of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

 

1. The extension, modification and termination of compulsory medical measures are carried out by the court on the recommendation of the administration of the institution providing compulsory treatment, based on the conclusion of the commission of psychiatrists.

2. A person who has been prescribed a compulsory medical measure is subject to examination by a commission of psychiatrists at least once every six months to decide whether there are grounds for submitting a submission to the court to terminate or amend such a measure. In the absence of grounds for termination of the application or modification of a compulsory medical measure, the administration of the institution providing compulsory treatment shall submit to the court an opinion for the extension of compulsory treatment. The first extension of compulsory treatment may be made after six months from the date of the start of treatment, and the subsequent extension of compulsory treatment is carried out annually.

3. The change or termination of a compulsory medical measure is carried out by the court in the event of such a change in the mental state of a person, in which there is no need to apply the previously prescribed measure or there is a need to prescribe another compulsory medical measure.

4. In case of termination of compulsory treatment in a psychiatric hospital, the court may transfer the necessary materials regarding the person who was undergoing compulsory treatment to the health authorities to resolve the issue of his treatment or referral to a neuropsychiatric organization in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan in the field of healthcare.
