Article 86. The rights of the owner or non-governmental land user in the case of compulsory alienation of land for state needs of the Land Code of the Republic of Kazakhstan
1. From the date of receipt of the notification of the commencement of compulsory alienation of a land plot for state needs until the state registration of the right of state ownership of a land plot or termination of the right of land use, the owner or non-governmental land user has the right to exercise his right to a land plot and other immovable property, to make the necessary expenses to ensure the use of this property in accordance with its intended purpose. At the same time, the owner or a non-governmental land user bears the risk of attributing to him the costs and losses associated with the new construction, expansion or reconstruction of buildings (structures, structures) and other objects of immovable property on such a land plot during the specified period.
If the owner or a non-governmental land user, after the forced alienation of a part of the land plot for state needs, cannot use the remaining part for its former intended purpose, the entire land plot is redeemed.
2. In case of transfer of rights to a land plot and other immovable property during the time specified in paragraph 1 of this Article to another person by alienation or on other grounds, as well as in case of change of the rightholder by virtue of universal succession, the procedure of compulsory alienation of the land plot shall be applied (continued) in respect of the new rightholder.
