Article 86. Exemption from liability of the Railway Transport Act
1. The parties may be released from liability for non-fulfillment or improper fulfillment of obligations arising from the contract of carriage on the grounds provided for by the Civil Code of the Republic of Kazakhstan, this Law, and international treaties of the Republic of Kazakhstan.
2. The parties are released from liability if non-fulfillment or improper fulfillment of obligations occurred as a result of:
1) force majeure, as well as emergency situations of a social, natural and man-made nature;
2) military operations, the introduction of a state of emergency;
3) the termination or restriction of the movement of goods, train traffic, announced in accordance with the procedure established by this Law.
The Law of the Republic of Kazakhstan dated December 8, 2001 No. 266.
This Law regulates public relations between carriers, participants in the transportation process, government agencies, passengers, senders, recipients, shippers, consignees, and other individuals and legal entities when transporting passengers, baggage, cargo, baggage, and mail by rail.
