Article 8. Requirements for credit bureaus to protect and ensure the safety of the database of credit histories, information systems used and premises of the Law on Credit Bureaus and the Formation of Credit Histories in the Republic of Kazakhstan

  Credit bureaus are required to ensure that the following organizational, technical, and technological requirements are met:  

      1) have technical and other facilities for the safe placement and operation of digital systems, databases of credit histories and other documents;  

      2) when forming and using digital systems to host a database of credit histories and means of protecting these digital systems, use certified equipment and software;  

      3) ensure that contracts concluded with information providers and recipients of credit reports contain conditions for the mandatory joint implementation of organizational, technical measures and technological requirements for software protection used in the formation and operation of digital systems used to create a database of credit histories and means of protecting these digital systems;  

      4) ensure the availability of a backup server located outside the city where the credit bureau is located to store backup copies of the information of the subject of the credit history.

The article was amended and supplemented by the Law of the Republic of Kazakhstan dated July 23, 2026, No. 352-VIII SAM. 

     This Law defines the legal, economic and organizational foundations of the formation of credit histories in the Republic of Kazakhstan, the legal status of participants in the system of formation of credit histories and their use, regulates public relations related to the creation, implementation and termination of activities of credit bureaus, the specifics of state regulation, control and supervision in this area.
