Authorized body:

1) performs strategic, regulatory, implementation and control functions within its competence;

1-1) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms the state policy in the field of the defense industry in accordance with the current legislation of the Republic of Kazakhstan;

2) participates in the implementation of a unified military-technical policy and state policy in the field of industrial safety;

3) organizes and implements cooperation with the Armed Forces of the Republic of Kazakhstan, other troops and military formations, special state and law enforcement agencies of the Republic of Kazakhstan in the field of defense industry;

4) participates in the organization of current and future planning to ensure the needs of defense, security and law and order in the state with the necessary types of weapons, military, automotive and special equipment, technical and special means;

5) participates in the implementation of military-technical cooperation;

6) organizes and implements interaction with central executive bodies, state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments in the field of military-technical cooperation; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

7) organizes and conducts activities for the development of military-industrial potential;

8) organizes the activities of subordinate organizations, as well as organizations under trust management;

9) makes decisions and determines the procedure for providing state support measures to organizations of the military-industrial complex;

10) formulates proposals for inclusion in the state educational order to determine the list of specialties that require the training of specialists for the military-industrial complex, taking into account the monitoring of current and future needs for qualified personnel by organizations of the military-industrial complex.;

11) develops and approves the rules for certification and issuance of a certificate of an organization for maintenance and repair of aviation equipment of the state aviation;

12) develops and approves certification requirements for organizations involved in the maintenance and repair of state aviation aircraft;

13) develops rules for the turnover of weapons and military equipment;

13-1) develops rules for the transfer of property between law enforcement and special state bodies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations during the introduction of a state of emergency or martial law throughout the territory of the Republic of Kazakhstan and in its individual localities;

14) develops a list of subjects having the right to use weapons and military equipment;

15) exercises state control over the turnover of weapons and military equipment, with the exception of the case provided for in subparagraph 4) of Article 7 of this Law;

16) develops rules for the transfer, sale, liquidation through destruction, disposal, burial and recycling of unused property, as well as the provision of unused defense facilities for property hire (lease);

16-1) develops and approves rules for organizing the production activities of ammunition and explosives disposal facilities, ensuring safety during these operations and protecting ammunition and explosives disposal facilities;

17) disposes of unused property and makes decisions on the transfer, sale and liquidation through the destruction, disposal, burial and processing of unused property in accordance with the procedure established by the Government of the Republic of Kazakhstan, and the transfer of unused property as a property contribution to the authorized capital of limited liability companies or to pay for the purchase of shares of joint-stock companies;

18) participates in the formation of the state defense order;

19) develops rules for the formation, placement and execution of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

20) develops pricing rules for military goods (products), dual-use goods (products), military works and military services within the framework of a state defense order in coordination with the antimonopoly authority; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

21) forms, approves and maintains a register of domestic manufacturers of military goods (products), dual-use goods (products) and domestic suppliers of military works and military services of the state defense order in accordance with the rules for the formation, placement and execution of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

22) selects the executor of the state defense order, except in cases where budgetary funds within the framework of the state defense order are provided for in the budget of the recipient of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

23) formulates a state defense order, submits it for approval to the Government of the Republic of Kazakhstan and brings the tasks of the approved state defense order to the executors of the state defense order in accordance with the rules for the formation, placement and execution of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

24) concludes a contract for the execution of a state defense order with the executor of the state defense order, except in cases where budgetary funds under the state defense order are provided for in the budget of the recipient of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

25) carries out financing of the state defense order, except for cases when budgetary funds within the framework of the state defense order are provided in the budget of the recipient of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

26) decides on the redistribution of budgetary funds within the framework of the state defense order within the limits allocated for the planning period, in case of savings, reduction or increase in the amount of the contract, extension of the term of the contract for the execution of the state defense order, when budgetary funds within the framework of the state defense order are provided for in the budget of the authorized body; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

27) provides military goods (products) and dual-use goods (products) to recipients of the state defense order, except in cases where budgetary funds under the state defense order are provided for in the budget of the recipient of the state defense order.; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

28) ensures that military goods (products), dual-use goods (products), military works and military services purchased under the state defense order comply with the tactical and technical specifications (technical specifications, tactical and technical characteristics) when budgetary funds under the state defense order are provided for in the budget of the authorized body, in accordance with the rules for the formation, placement and execution of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

29) carries out intersectoral coordination of scientific research;

30) coordinates the implementation of military technology projects;

31) develops and approves the rules for the organization and conduct of scientific research within the framework of the state defense order in coordination with interested central executive bodies, government agencies directly subordinate and accountable to the President of the Republic of Kazakhstan;

32) develops and approves the rules for conducting scientific research expertise within the framework of the state defense order in coordination with interested central executive bodies, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan;

33) develops specialized scientific directions within the framework of the state defense order in coordination with interested central executive bodies, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan;

34) creates expert councils in specialized scientific fields within the framework of the state defense order (hereinafter referred to as expert councils), approves their provisions and compositions in coordination with interested central executive bodies, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan;

35) approves reports on completed scientific research, except in cases where budgetary funds under the state defense order are provided for in the budget of the recipient of the state defense order; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

36) develops and approves the rules for testing the results of development and technological work in coordination with interested central executive bodies, government agencies directly subordinate and accountable to the President of the Republic of Kazakhstan; - Excluded by the Law of the Republic of Kazakhstan dated July 16, 2025 No. 211-VIII SAM.

37) participates in scientific research;

38) organizes the development of scientific and scientific-technical projects financed from the state budget, and provides guidance on their implementation;

39) develops and approves rules for the development, coordination, approval, registration, accounting, modification, revision, cancellation and implementation of military national standards used for the needs of the Armed Forces of the Republic of Kazakhstan, other troops and military formations;

40) develops, coordinates, approves, modifies, cancels military national standards and keeps records of them;

41) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

This Law regulates public relations in the field of the defense industry, the state defense order, as well as certain issues of the turnover of weapons and military equipment.
