Article 312. Appointment and dismissal of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan of the Entrepreneurial Code of the Republic of Kazakhstan
1. A person appointed to the position of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan must meet the following requirements:
1) have the citizenship of the Republic of Kazakhstan;
2) have a university degree;
3) have at least five years of work experience in the field of protecting the rights and legitimate interests of entrepreneurs.
2. The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan is appointed to the post by order of the President of the Republic of Kazakhstan for a period of four years.
3. The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan may be prematurely dismissed from his post by decision of the President of the Republic of Kazakhstan on the following grounds:
1) own desire;
2) a state of health that prevents the further performance of professional duties, in accordance with a medical opinion;
3) non-compliance with the duties and restrictions established by this Code;
4) violation of official powers, commission of misconduct incompatible with being in office;
5) departure for permanent residence outside the Republic of Kazakhstan.
4. The powers of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan shall be terminated in the following cases::
1) termination of citizenship of the Republic of Kazakhstan by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan;
2) the entry into force of a court decision recognizing the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan as legally incompetent or with limited legal capacity, or applying compulsory medical measures to him;
3) the entry into force of the court's verdict of guilty against the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan;
4) the death of the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan or the entry into force of a court decision declaring him deceased.
5. The same person may not be appointed to the position of Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan more than twice in a row.
