Article 19. Restrictions related to the employee's stay in the service of the Law on Special State Bodies of the Republic of Kazakhstan

Article 19. Restrictions related to the employee's stay in the service of the Law on Special State Bodies of the Republic of Kazakhstan

     1. An employee may not:

     1) to be a deputy of representative bodies and a member of local self-government bodies, to be a member of political parties, trade unions, to support any political party, to create public associations in the system of special state bodies pursuing political goals based on the commonality of their professional interests to represent and protect labor, as well as other socio-economic the rights and interests of its members and the improvement of working conditions;

     2) engage in other paid activities other than teaching, scientific and other creative activities, except in cases where this is his official duties in accordance with the legislation of the Republic of Kazakhstan;

3) engage in entrepreneurial activity, except in cases where it is his official duties in accordance with the legislation of the Republic of Kazakhstan.;

3-1) participate in the management of a commercial or non-profit organization, except in cases where this is his official duties in accordance with the legislation of the Republic of Kazakhstan or is necessary for the management of shares specified in subparagraph 3-2) of this paragraph, or is participation on a gratuitous basis in the management of a consumer or housing and construction cooperative;

     3-2) acquire securities, except for the acquisition and (or) sale, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, of shares of open and interval mutual funds, bonds, shares of commercial organizations (common shares in the amount not exceeding five percent of the total number of voting shares of organizations)

     4) be a representative in the affairs of third parties, except in cases stipulated by the laws of the Republic of Kazakhstan;

     5) to use for non-official purposes the means of material, technical, financial and informational support of his official activities, other state property and official information;

     6) participate in actions that impede the normal functioning of government agencies and the performance of official duties, including strikes;

     7) in connection with the performance of official duties, use the services of individuals and legal entities for personal purposes;

     8) to use his official position for personal gain, including by collusion with officials and other persons;

     9) hold a position directly subordinate to the position held by his close relatives (parents, children, adoptive parents, adopted children, full- and half-siblings, grandfathers, grandmothers, grandchildren), spouse and (or) relatives (full- and half-siblings brothers and sisters, parents and children of the spouse, as well as have close relatives, spouse and (or) relatives directly subordinate to them.;

     10) refuse or evade medical examination in medical organizations to establish the fact of using a psychoactive substance and intoxication at the direction of an authorized supervisor.

     Refusal and evasion from passing an examination entail dismissal from service in special state bodies.

2. An employee, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, within thirty calendar days from the date of assuming office, is obliged, for the duration of his service, to transfer to trust management property belonging to him by right of ownership or other property right, the use of which entails income, with the exception of money, bonds, shares of open and interval mutual funds, shares commercial organizations (common shares in the amount not exceeding five percent of the total number of voting shares of organizations), digital assets, legally owned by him, as well as property transferred to a property lease (lease), and submit a notarized copy of the property trust management agreement to the personnel department within the specified period.

     An employee has the right to lease (lease) a dwelling belonging to him by right of ownership and receive income from such rental, as well as receive income from property transferred to trust management and from other legitimate sources.

     2-1. Special state bodies have the right to conduct special inspections of employees in accordance with the procedure established by the legislation of the Republic of Kazakhstan. The State bodies of the Republic of Kazakhstan provide assistance to special state bodies in conducting a special audit.

2-2. Anti-corruption restrictions imposed by employees are established by this Law and the Law of the Republic of Kazakhstan "On Combating Corruption".

     Anti-corruption restrictions imposed by political civil servants are established by this Law and other laws of the Republic of Kazakhstan.

     3. Responsibility for non-compliance with the restrictions provided for in this article is established by this Law and other laws of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated February 13, 2012 No. 552-IV.

This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
