Article 10. Actions that are not recognized as a violation of the exclusive right of the copyright holder of the Law On the Legal Protection of Integrated Circuit Topologies

Article 10. Actions that are not recognized as a violation of the exclusive right of the copyright holder of the Law On the Legal Protection of Integrated Circuit Topologies  

      It is not recognized as a violation of the exclusive right of the copyright holder:  

      1) performing the actions specified in subparagraph 2) of paragraph 4 of Article 7 of this Law with respect to integrated circuits with illegally reproduced topology or products containing such integrated circuits, if the person making such use did not know and should not have known that these integrated circuits or products containing such integrated circuits were manufactured and they are distributed in violation of the exclusive right to the topology. Upon receipt of the appropriate notification from the copyright holder, this person has the right to perform any of the actions with respect to the products available or ordered up to that time, provided that the copyright holder receives a commensurate remuneration that would have been paid if he had freely acquired a license for such a topology.;  

      2) the use of topology for personal purposes without making a profit, as well as for evaluation, analysis, research or training purposes;  

      3) the inclusion of a protected topology in another original topology created on the basis of its assessment or analysis and the commission of actions in relation to such topology specified in paragraph 4 of Article 7 of this Law.;  

      4) distribution of an integrated circuit with a protected topology that has been legally introduced into civil circulation;  

      5) performing the actions specified in paragraph 4 of Article 7 of this Law in relation to an identical original topology independently created by another author of the topology.
