Article 42. Features of requisition during the introduction of a state of emergency in natural and man-made emergency zones of the Law on State Property
1. When a state of emergency is imposed in areas of natural and man-made emergencies, the head of the emergency rescue service, which carries out measures to eliminate natural and man-made emergencies, has the right to independently, under personal responsibility, requisition the necessary property to carry out the necessary rescue and emergency recovery work.
2. The seizure of property is carried out on the basis of a requisition act, which must contain:
1) the grounds for the requisition;
2) time and place of withdrawal;
3) information about the official conducting the requisition, indicating the position, title and name, as well as the details of the order appointing persons authorized for the requisition, the owner of the property being requisitioned, and other persons present at the seizure;
4) an inventory of the property being requisitioned, indicating the weight, measure, quality and type of packaging, title documents, information on state registration and other individually defined characteristics;
5) information on the valuation of the property and the amount of compensation;
6) other necessary information about the requisition and the property being requisitioned.
3. One copy of the act of requisition is given to the owner of the requisitioned property or his authorized representative.
4. A report is drawn up on the requisition, which, with the attached acts on requisition, is sent in accordance with the procedure established by the legislation of the Republic of Kazakhstan to the authorized body in the field of civil protection and local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance.
