On accession of the Republic of Kazakhstan to the Charter of the International Civil Defense Organization

Law of the Republic of Kazakhstan dated October 31, 1997 No. 182

     To include the Republic of Kazakhstan in the Charter of the International Civil Defense Organization, adopted on October 17, 1966.

     Introduction

     In order to develop and improve the organization, intensify and harmonize on a global scale the ways and methods of preventing and reducing the consequences of disasters caused by the use of weapons in peacetime or conflict situations, the contracting states adopt the following Charter:

     Part I-organization institution

  Article 1

     The International Civil Defense Organization (hereinafter referred to as the" organization") is established in accordance with the Charter.

     Part II-Services

  Article 2

     The activities of the organization are: a) establishing and maintaining close cooperation between organizations charged with the tasks of rescuing the population and property; b) assisting in the creation and expansion of such organizations in countries where there are no civil defense organizations and, at the request of countries, assisting in the creation and expansion of organizations for the protection of the population and property; c) establishing and maintaining effective cooperation with specialized institutions, public services, professional groups and other organizations deemed;       d) support and ensure the exchange of Information, experience, personnel and experts between each country in the field of protection and rescue of the population and property; f) provide necessary technical assistance at the request of member states, with instructors, experts, equipment and items, as necessary, including the provision of plans of organizations; g) establish and support technical services that are required, including documentation centers, equipment preparation, research and other centers;       h) collection and transmission of messages on issues in the field of Defense and principles of action of the organization in the event of threats to the population from mudslides, earthquakes, avalanches, large fires, storms, dam breaks and other shocks, as well as air pollution by water or the use of modern methods of conducting military actions; i) reporting on issues of protection and rescue of the population and property, collection and provision of research, scientific works and special documents;       j) collect and provide information on current equipment and items used in the implementation of operations in the event of a threat taken into account in Point "G"; k) assist member states in the formation of a public opinion among the population about the vital necessity of prevention, protection and active response in the event of an accident; l) participate in the exchange of knowledge and experience;       m) organizations and groups providing assistance in the event of a major disaster, intensifying the efforts of various rescue organizations and groups; n) involvement of member states and participation in relief operations in the event of major disasters; O) training and training of skills on training,training and equipping personnel for rescue and protection organizations; p) assistance in scientific research using information, research publications and other appropriate methods on protection and protection of the population and property.

     Part III-members of the organization

  Article 3

     Admission to membership of the organization is open to all states.

  Article 4

     According to their constitutional procedure, by signing the charters, states can become members of the organization.

  Article 5

     In case of non-fulfillment by a member of an organization of his financial obligations under organizations or any other obligations stipulated by this charter, a resolution shall be adopted by the General Assembly on temporary deprivation of the rights and privileges granted to him as a member of the organization until he does not fulfill his financial or other obligations.

  Article 6

     A member of any organization may leave the organization's membership if he has issued a written warning to the secretary-general twelve months in advance and immediately informs all members of the organization that he has received such a warning.

     Section IV-bodies

  Article 7

     The work of the organization is carried out by: a) The General Assembly (hereinafter referred to as the "Assembly") B) the Executive Council (hereinafter referred to as the "Council") C) the Secretariat

     Part V-General Assembly

  Article 8

     The assembly, which is the highest body of the organization anddifferent-consists of Representatives representing the state.

  Article 9

     Each member state is represented by one representative.

  Article 10

     The Assembly meets for regular sessions at intervals of no more than two years and, if necessary, for special sessions. Special sessions are convened at the request of the council or the majority member states.

  Article 11

     At each regular session, the Assembly selects the country where the next regular session will take place, and at the same time, the council determines the place of the future session. The place of the special session is determined by the Council.

  Article 12

     At the beginning of each regular session, the Assembly elects the chairman and chairman, as well as other members of the presidium. These people retain the powers of their chairmen until they are elected.

  Article 13

     The Assembly sets its own procedure routines.  

  Article 14

     In addition to the functions agreed in other articles of the specific charter, the main additional tasks of the Assembly are: a) establishing the services agreed in Article 2 for the implementation of the activities of the organization; B) establishing the member states of the organization, to which the Executive Council is entitled to appoint its representatives; C) appointing the Secretary-General; D) reviewing and approving reports and services of the Council and the secretary-general; e) instructing the council when necessary and establishing commissions of the organization;       e) control over the financial policy of the organization and review and approval of the budget; G) assist in conducting and conducting research in the field of protection and rescue by the forces of the organization's personnel, through their own research, the creation of research institutes or cooperation with official and non-official institutions of any member states in agreement with its government; H) creation of any other organizations deemed appropriate;       (I) to convene any international or national, governmental or non-governmental organizations similar to the issues of the organization, to appoint representatives to participate in their own meetings or conferences convened by them, as established by the General Assembly; the invitation shall be sent only with the consent of the appropriate government; (d) to establish rules, especially general rules, the financial situation and the personnel regulation of the organization, which;       L) creation of technical commissions in accordance with the provisions of Section IX,establishment of their activities, coordination of their activities and consideration of their proposals; m) determination of the location of the Secretariat of the organization; H) adoption of various other coordinated measures that will lead to the achievement of the goals of the organization.

  Article 15

     Each member state has one vote in the Assembly, and decisions, consent or objection are made by a majority of two-thirds.

  Article 16

     For the quorum at the meetings of the Assembly, the participation of the majority of representatives of the member states is required.

     Part VI-Executive Board

  Article 17

     The Executive Council is the executive Organization of the organization.

  Article 18

     The assembly, taking into account its fair geographical distribution, sets the number of members of the Executive Council and elects members who are entitled to appoint their representatives to the Council.

  Article 19

     Members of the council are elected for a term of four years; half of the members are re-elected annually.

  Article 20

     The council holds its meetings at least once or twice a year and determines the venue for each of its meetings.

  Article 21

     A special session of the Executive Council, in accordance with the procedure provided for in the regulations, is convened after receiving an application from the majority of the members of the Executive Council, the secretary general.

  Article 22

     The council elects its chairman and deputy chairman from among its members.

  Article 23

In addition to the activities established by other articles of the main Charter, the main functions of the Executive Council are: a) to implement the decisions taken by the Assembly and direct the activities of the organization in accordance with the purpose of these decisions; B) to study all issues related to the protection and protection of the population and property on an international scale; C) to prepare the agenda of the Assembly and prepare the instructions of the technical committees, their agenda; D) to present a report on its activities to the session of the assembly;       e) manage the finances of the organization in accordance with the provisions of Section X of the Charter; e) advise the assembly on issues submitted by the Assembly or arising before the organization in connection with conventions, agreements and regulations; G) give advice and recommendations to the Assembly on their own initiative; H) submit the general program of work for consideration and approval by the assembly for a certain period of time; I) study all issues falling within its competence; K) take measures in cases requiring immediate action on the limits of The Walking environment and the possibilities of the organization's finances;       (L) authorizing the secretary-general to take necessary measures to conduct rescue operations in case of disaster; (m) studying and examining the work of the council, any member of the organization or the secretary-general that needs to be resolved; (H) implementing any other functions that may be assigned to him by the Assembly.

  Article 24

     Each council member has one vote. The decision is made by a large number of votes cast.

  Article 25

     The quorum at meetings of the council is two-thirds members.

     Section VII-Secretariat

  Article 26

     The permanent secretariat of the organization consists of the secretary general and the technical and administrative staff, which remain essential for the work of the organization.

  Article 27

     The secretary-general is appointed on the recommendation of the Council under the circumstances established by the Assembly. The secretary general is the chief technical andadministration official of the organization.

  Article 28

     The secretary-general is the Secretary of the Assembly and council by position (ex owwicio) and participates in all commissions of the organization by position (ex owwicio). He can entrust the performance of these services to other people.

  Article 29

     The secretary-general annually compiles and submits to the Council the organization's financial statements and budget estimates.

  Article 30

     The secretary-general appoints the staff of the Secretariat in accordance with the personnel regulations established by the Assembly. When hiring personnel, the general opinion should be that it is necessary to ensure the highest level of employability, responsibility and international authority of the Secretariat. Due attention is paid to the fact that the selection of personnel is as important as possible on a broad geographical basis.

  Article 31

     The working conditions of the organization's personnel should be as similar as possible to those of other international organizations.

  Article 32

     In the performance of their duties, the secretary-general and staff may receive recommendations or instructions from any government or authority that is alien to the organization. They should refrain from any actions that affect the position of their international officials. Each member of the organization, for its part, undertakes to consider only the international differences of the duties of the secretary general and staff and does not attempt to influence them in the performance of their duties in relation to the organization.          Part VIII-conferences

  Article 33

     The organization implements the tasks assigned to it, which are listed in Article 2, organizes general and local conferences, symposia and other technical councils. Representatives of states that are not members of the organization may participate in these meetings as listeners, as well as representatives of other international and non-governmental organizations. The distinction of such powers is established by the Assembly or council.

  Article 34

     In the opinion of the council, at conferences in which the organization is interested, the council and the secretary general review the powers of the organization in advance.

     Section IX-commissions

  Article 35

     The council, at the direction of the Assembly, appoints the following commissions and any other commissions that, on its initiative (initiative) or at the suggestion of the secretary-general, are intended to implement any goals within its competence.

  Article 36

     The council from time to time and in any case annually reviews the issues of the need for the subsequent existence of each technical commission.

  Article 37

     Members of the organization are authorized in such technical commissions.

  Article 38

     Each technical commission elects its own chairman. He may participate in meetings of the council with the Assembly without the right to vote.

  Article 39

     The council, along with other organizations of this kind, can make decisions on the formation or participation of the organization.

     Section X-Finance

  Article 40

     The secretary-general makes annual budget estimates of the organization and submits them to the council, the council reviews these budget estimates to the Assembly, together with any guarantees that the council considers appropriate, and submits them.

  Article 41

     In the budget estimates submitted by the Executive Council, the assembly establishes the maximum total amount of expenses of the organization.

  Article 42

     The costs of the organization are distributed among the organization's members in accordance with the commissioner established by the Assembly.

  Article 43

     The Assembly sends authority to the Executive Council on the volume set by the Assembly, which is necessary to approve the annual expenses of the organization.

  Article 44

     The assembly or Council, which has power on behalf of the Assembly, may accept gifts and donations if they are acceptable to the Assembly or council and correspond to the goals and policies of the organization.

  Section XI-reports submitted by Member States

  Article 45

     Each member state sends to the organization laws, regulations, official regulations and statistics related to the protection and rescue of the population and property.

     Section XII-legal status

  Article 46

     On the territory of the country where its headquarters is located, the organization uses the legal capabilities and methods that it needs to fulfill its goals and functions.

  Article 47

     In the territory of the country where its headquarters are located, the organization enjoys its objectives with the benefits that remain necessary to carry out its objectives and services.

  Article 48

     Officials and officials of the organization use the territory of the country where their headquarters are located, with the benefit necessary for them to freely perform their activities related to the activities of the organization.

     Section XIII-amendments

  Article 49

     The Secretary-General informs the member states six months before the text of the proposed amendments to this Charter is considered by the Assembly. The amendments come into force by all member states upon their approval by a two-thirds majority vote of the Assembly and upon their adoption by the two-thirds member state in accordance with the constitutional procedure.

     Section XIV-relationships with other organizations

  Article 50

     The organization establishes productive and close cooperation with intergovernmental and non-governmental organizations that remain worthy of it.

     Section XV-entry into force

  Article 51

     With the observance of the provision of Section III of this charter, all of itwill remain open for signing or adoption by the states.

  Article 52

     This charter comes into force when 10 states join it.

  Article 53

     After ratification or entry into force of the charter, the Charter shall enter into force on the thirtieth day from the date of their transfer for storage of their documents of ratification or accession to the acceding state.       In the case of representatives of compatible governments, they signed this Charter as a certificate.       On the seventeenth of October of the year one thousand nine hundred and sixty-sixth, the original text was held in Monaco, created in a single copy in Chinese, English, French, Russian and Spanish, each text identical to the original, with the signature of this charter, sending certified copies to all states.
