EUROPEAN AGREEMENT
(KTZ)
CONTRACTING PARTIES
Wishing to promote the simplification of international cargo transportation,
Realizing that the expected increase in international freight traffic is due to the expansion of international trade,
Recognizing the adverse consequences of such development for the environment,
Emphasizing the important role of combined transport in reducing the stress on the European road network, in particular in inter-Alpine communication and reducing environmental damage,
In order to increase the efficiency of international combined transport in Europe and their attractiveness to consumers, it is important to establish on the basis of agreed international parameters and standards the legal framework that determines the agreed Development Plan of combined transport and the infrastructure necessary for their implementation,
the following are agreed:
CHAPTER I GENERAL PROVISIONS
Article 1 definitions in the application of this Agreement:
a) the term" combined transportation " means the transportation of goods using several modes of transport with one transport unit;
b) the term" hub of important international combined transport networks " is used if:
I) today they are used for regular international combined transportation (for example, giant boxes ,containers, semi-trailers);
II) if they are used as essential additional lines for international combined transport;
(III) if they are expected to be the most important lines of combined transport in the near future (as established in paragraphs I and II)), they include all railway lines that are considered important for international combined transport;
C) the term" relevant facilities " includes terminals used for combined transportation, border crossings, exchange stations with car groups, Exchange stations with wheel pairs and railway-ferry crossings/ports that are of significant importance for international assembled transportation.
Article 2 network definition
The Contracting Parties shall adopt the provisions of this Agreement as a agreed international development and functioning plan for the hub of important international combined transport networks and relevant facilities, referred to below as the "international combined transport hub", intended to be implemented within the framework of their national programs. The international combined transport hub includes the railway lines specified in Annex I of this Agreement, terminals used for combined Transport, border crossings, wheel-pair replacement stations and railway-ferry crossings/ports of significant importance for international combined transport and listed in Annex II of this Agreement.
Article 3 technical characteristics of the network
The railway lines of the international combined transport hub must comply with the characteristics set out in Annex III to this Agreement or are brought into line with the provisions of this annex in the course of further improvement work carried out within the framework of national programs.
Article 4 goals in the field of Transportation
In order to simplify international combined transport carried out at the international combined transport hub, the Contracting Parties shall take appropriate measures to achieve user characteristics and minimum standards for trains used in combined transport and the relevant facilities specified in Annex IV to this Agreement.
Article 5 annexes
The annexes to this Agreement are an integral part of the agreement. New annexes covering other aspects of combined transfers may be added to the agreement in accordance with the procedure for making amendments defined in Article 12.
CHAPTER II FINAL PROVISIONS
Article 6 determination of the depository
The secretary-general of the United Nations is the depositary of this Agreement.
Article 7 signing
1.this agreement is open for signature by states that are members of the United Nations Economic Commission for Europe or have been sent to participate in the work of the Commission with advisory status in accordance with paragraphs 8 and 11 of the regulations on the scope of proceedings of this Commission at the United Nations Office in Geneva from April 1, 1991 to March 31, 1992.
2.such a signature is subject to acceptance or approval.
Article 8 ratification, adoption or approval
1.this agreement is subject to ratification,acceptance or ratification in accordance with paragraph 2 of Article 7.
2.Ratification, adoption or approval shall be carried out by submitting to the secretary-general of the United Nations for storage a document drawn up in the appropriate form.
Article 9 accession
1.this agreement is open for accession by the states referred to in Paragraph 1 of Article 7 from April 1, 1991.
2.accession shall be carried out by submitting the relevant document for storage to the secretary-general of the United Nations.
Entry into Article 10
1.this Agreement shall enter into force after 90 days from the date of depositing the document of acceptance, approval or accession by the governments of the eight states, provided that one or more lines of the international combined transport hub, if any, will continuously connect the territory of the four states that have deposited such document.
2.in case of non-fulfillment of the above-mentioned agreement, the agreement shall enter into force upon the expiration of 90 days from the date of deposit of the document of acceptance, approval or accession, in which this agreement is executed.
3.in respect of each state that has deposited a document of acceptance, approval or accession, specified in Paragraphs 1 and 2 of this article, after a date of beginning of 90 days, the agreement shall enter into force upon the expiration of 90 days from the date of deposit of this document.
Article 11 restrictions on the application of this agreement
1.no provision of this Agreement should be understood as preventing any contracting party from taking measures that it considers necessary to ensure its external or internal security, compatible with the Charter of the United Nations and limited to the existing conditions.
2.these measures, which must be of a temporary nature, are immediately notified to the depositary with their description.
Article 12 dispute settlement
1.any dispute concerning the interpretation or application of this agreement between two or more contracting parties that the disputed parties cannot resolve by negotiation or other means of regulation shall be submitted to the arbitration court at the request of one of the contracting parties in which the dispute has arisen and shall, accordingly, be submitted to one or more arbitrators elected by common agreement of the disputed parties. If, within three months from the date of submission of the application for consideration of the case to the arbitration court, the parties to the dispute do not agree on the election of an arbitrator or arbitrator, either of these parties may submit their application for the appointment of a single arbitrator to resolve the dispute to the secretary-general of the United Nations.
2.the decision of an arbitrator or arbitrators appointed in accordance with the provisions of Paragraph 1 of this article shall be binding on the disputed Contracting Parties.
Article 13 notes
Each state may inform the depositary that it does not limit itself to Article 12 of this agreement when signing or depositing a certificate of approval or a document of acceptance, approval or accession for storage.
Article 14 introduction of amendments to the agreement
1.this Agreement may be amended in accordance with the procedure provided for in this article, except as provided for in Articles 15 and 16.
2.at the request of any contracting party, any of its proposals to amend this Agreement shall be considered by the United Nations Economic Commission for Europe working group on combined transport.
3.If the amendment is approved by a two-thirds majority of the Contracting Parties participating in the vote, the secretary-general of the United Nations shall send the amendment to all contracting parties for adoption.
4.any proposed amendment sent in accordance with paragraph 3 of this article shall enter into force in respect of all Contracting Parties three months after the end of the twelve-month period, the duration of which is calculated from the time of its submission, if during this twelve-month period the secretary-general of the United Nations has not received notification of any state that is a contracting party
5.if a statement of objection is submitted against the proposed amendment in accordance with paragraph 4 of this article, the amendment shall be considered rejected and shall not be valid.
Article 15 amending Annexes I and II
1.Annexes I and II to this Agreement may be amended in accordance with the procedure set out in this article.
2.at the request of any contracting party, any proposal to amend Annexes I and II shall be considered by the United Nations Economic Commission for Europe working group on combined transport.
3.If the amendments are approved by a majority of the contracting parties who have come and participated in the vote, the secretary-general of the United Nations shall send the proposed amendment to the directly interested contracting parties for adoption. For the purposes of this article, the contracting party is considered to be directly interested in the operation of a new line, an important terminal, a border post, a wheel-pair replacement station or a railway-ferry crossing/port, or in the event of their change, respectively, when its territory intersects with this line, or is directly connected to an important terminal, or when the important terminal in question, a border post, a wheel-pair replacement station or the last point of a railway-ferry crossing/port is located in the specified territory.
4.any proposed amendment addressed in accordance with paragraphs 2 and 3 of this article shall be deemed adopted if, within six months from the date of its submission by the depositary, neither one of the directly interested contracting parties has declared to the secretary-general of the United Nations that it opposes the proposed amendment.
5.the secretary-general of the United Nations shall notify all Contracting Parties of any amendment adopted in this manner, which shall enter into force three months after the date of its notification by the depositary.
6.if a statement of objection is sent against the proposed amendment in accordance with paragraph 4 of this article, the amendment is considered rejected and has no effect.
7.the secretariat of the European Economic Commission shall, without delay, inform the depositary of the contracting parties directly interested in the proposed amendment.
Article 16 making amendments to annexes III and IV
1.annexes III and IV of this Agreement may be amended in accordance with the provisions of this article.
2.at the request of any contracting party, any proposal to amend annexes III and IV shall be considered by the United Nations Economic Commission for Europe working group on combined transport.
3.if the amendment is approved by a two-thirds majority of the contracting parties who have come and participated in the vote, the secretary-general of the United Nations shall send the amendment to all contracting parties for adoption.
4.any proposed amendment addressed in accordance with paragraph 3 of this article shall be considered adopted if, after six months from the date of its submission, one fifth or more of the contracting parties have not declared their opposition to this amendment to the secretary-general of the United Nations.
5.the Secretary-General shall notify all Contracting Parties of any amendment adopted in accordance with paragraph 4 of this article, the amendment shall enter into force in respect of all contracting parties, except for those who, after three months from the date of this notification, have declared to the secretary-general that they do not accept the proposed amendment before the date of entry into force of the amendment.
6.if one fifth or more of the contracting parties declare their opposition to the proposed amendment in accordance with paragraph 4 of this article, the amendment shall be considered rejected and shall not be valid.

Article 17 protective note
The provisions of this Agreement do not have any precedence over the provisions that some states may be forced to apply in reciprocity in accordance with other multilateral treaties, such as the Rome Treaty of 1957 on the establishment of the European Economic Commission.
Article 18 revocation
1.any contracting party may terminate this agreement by written notification addressed to the Chief Secretary of the United Nations.
2.the cancellation shall enter into force upon the expiration of one year from the date of receipt of the specified notification by the secretary-general.
Article 19
TERMINATION OF POWER
If, during any period of the next twelve months after the entry into force of this Agreement, the number of contracting parties is less than eight, this Agreement shall cease to be valid after twelve months from the date on which the eighth state ceases to be a contracting party.
Article 20 statements and notices of the depositary
In addition to the statements and messages that may be defined in this Agreement, the functions of the secretary-general of the United Nations as a depository are defined in Section VII of the Vienna Convention on the law of international treaties concluded in Vienna on 23 May 1969.
Article 21 same text
The original of this Agreement, the texts of which are identical in English, Russian and French, shall be deposited with the secretary-general of the United Nations.
As proof of this, the signatories below, duly authorized to do so, have signed this Agreement.
It was done in Geneva on the first of February of the year one thousand nine hundred and ninety-first.

Appendix III-technical characteristics of the network of important international combined transport networks
Preliminary warnings
The parameters are shown in the table below. The values indicated in Column A of the table should be considered as important goals that must be achieved in accordance with national railway development plans. Any deviation from these values should be considered as a distinction.
Networks are divided into two main categories:
a) modern networks that can be improved if necessary; for example, changing their geometric characteristics is often difficult, and sometimes impossible, so the requirements for these networks must be softened;
b) new lines to be built.
The features shown in the table below, by analogy, should also apply to transportation by rail ferries, which, in appropriate cases, are a composite part of the railway network.

1. number of rows
International combined transportation networks should ensure high throughput and full compliance with traffic schedules.
In principle, these two requirements can be stored in two-line networks; however, the use of single-line networks is allowed only if other parameters specified in the agreement are met.
2. rolling stock load volume
This is the minimum volume of loading for international combined transport networks.
The use of the largest volumes of loading in new lines does not require large investments of capital, so the volume of the IAC C is selected.
Volume C, namely:
- to transport cargo vehicles and convoys of vehicles (a truck with a trailer, a connected vehicle, a tractor and a semi-trailer) corresponding to European road volumes (height 4 m and width 2.50 m) on special platform wagons, at a height of 60 cm above the level of rails;
- for the transportation of conventional semi-trailers with a width of 2.5 m and a height of 4 m on platform wagons with pockets equipped with conventional trolleys;
- for transportation of ISO containers with a width of 2.44 m and a height of 2.90 m on conventional railway platforms;
- transportation of double bodies with a width of 2.50 m on conventional railway platforms;
- opens the way to transport containers/double bodies 2.6 cm wide and 2.9 m high in the respective wagons.
On modern lines passing through mountainous areas (for example, the Pyrenees, Central spur, Alps, Jura, Apennines, Carpathians), there are many tunnels with volumes corresponding to the volume of a technical unit of loading or several large volumes in height along the axial line of the road. In almost all cases, it is not possible from an economic and financial point of view to enlarge them to the size of the IAC C.
Therefore, for modern networks, the volume B of the ITU has been selected, which, in particular, includes:
- for the transportation of ISO containers with a width of 2.44 m and a height of 2.90 m on railway platforms for the transportation of containers with cargo areas located at an altitude of 1.18 m above the level of rails;
- to transport combined bodies with a width of 2.5 M and a height of 2.60 m on conventional platforms (cargo area, located at an altitude of 1.246 m) ;
- transportation of semi-trailers on special wagon platforms with pockets;
- containers with a width of 2.6 M and a height of 2.9 M/opens the way for the transportation of low-Board bodies in special wagons.
Most modern international combined transport networks have MTW volumes in. Providing volume in networks that do not meet these standards does not require large investments.
3. minimum estimated speed
The minimum design speed determines the choice of geometric characteristics of the route (radius of turns and curves), safety devices (braking distance) and the stopping coefficient of the rolling stock.
4. Permissible shaft load
This is the permissible load on the shaft that international combined transport networks must withstand.
International combined transport networks must withstand the movement of the latest and future means of rolling stock, in particular:
-wagons with a load on the shaft of 20 tons, which corresponds to the C Class of the load of the ITU; 100 km/h according to the recent decisions of the ITU. at speed, a load of 22.5 T was assumed on the shaft of the car. The rules of the IAC are 120 km / h. at speed, the load limit on the shaft is set to 20 t.
According to the rules of the ITU, loads on the specified shaft are allowed when the diameter of the wheels is not less than 840 mm.
5. minimum useful length of overtaking tracks
In international transport networks, the smallest useful length of the overtaking tracks is of great importance for combined transport trains (see Appendix IV).
Appendix IV train operation description and minimum infrastructure requirements
A. requirements for an effective system of international combined transportation
1. in order to ensure the efficiency and speed of movement of transport flows based on modern production methods and the distribution of goods, International combined transportation must meet the following requirements:
a) carry out departure/arrival, regular transportation in accordance with the requirements of consumers (in particular, setting the latest and earliest loading time) ;
b) small duration of door-to-door transportation, high accuracy of schedule storage, guaranteed delivery times;
C) providing accurate and timely information on transport procedures, simple documentation, small risk of causing harm;
d) the ability to carry out the transportation of all types of standard containers, as well as all cargo units transported by road in international traffic in Europe. In this regard, it is worth considering those that are subject to the forecast of trends in the field of measuring the weight and volume of cargo units.
2. these requirements:
a) exceeding the speed of transportation (from the point of departure to the point of arrival, taking into account all stops), which must correspond to or exceed the speed of transportation by road from door to door;
b) use the non-working hours of the consignees (for example, transportation at night) so that they can deliver the cargo in the morning at the request of consumers;
(c) Provision of sufficient appropriate equipment and infrastructure capacity (e.g. adequate loading volumes) ;
d) use, if possible, direct trains (i.e., avoid overloading or maximally reducing shipments to other trains during transportation);
F) taking measures to improve the flow of transport through the use of modern communication systems.
3.to ensure and comply with the above requirements, trains and infrastructure must ensure an adequate level of efficiency, that is, meet certain minimum requirements that must be met by all relevant competent authorities in this direction of Transportation.
4.the following parameters and requirements are established, in particular, for routes with a large volume of traffic, that is, for routes where regular transportation is carried out by direct trains or large car batches. If it met the requirements of consumers and the relevant Railways, the transportation of single cars or special shipments could be carried out, as before, by conventional freight trains.
C. characteristics of train operation

If direct trains are organized, then trains should consist, if possible, of only a small number of cars, while cars of each group should go to only one delivery point. In addition, no stops should be made on the roads for reasons of use or for the purpose of border control.
6.rolling stock must meet the above standards regarding the speed and load on the shaft, as well as ensure the possibility of transporting all cargo units, which must take into account weight and volume.
7.trains used for combined transportation should use the highest priority. The schedule of their movement should be compiled in such a way as to meet the requirements of consumers regarding the reliability and stability of Transportation. ____________________ * These indicators should be achieved by about 2000. Higher indicators can be introduced earlier than the specified period, if they do not interfere with the development of international combined transport.
S. minimum requirements for railway lines
8.the full-time capacity of railway lines intended for combined transportation should be sufficient to avoid downtime of trains used for combined transportation. Such trains should not be stuck during overtime hours.
9.for the improvement of railway networks, the parameters given in Annex III are applicable.
D. Minimum terminal requirements
10. in order to effectively process shipments at terminals, the following requirements must be met:
A) ensure a minimum time break between the use of goods and the departure of cars, as well as between the arrival of trains and the readiness of cars to unload cargo units, which should not exceed one hour, if the requirements of consumers regarding the deadline for receiving or handing over goods are not satisfied by other means;
b) reduce as much as possible the downtime of motor vehicles (at least 20 minutes) that ensure the delivery and collection of cargo units;
C) terminal location:
- so that it can be accessed quickly and easily through highways from economic centers;
- within the limits of railway lines, it should be selected in such a way that it has a good connection with the main railway lines, and in the case of transportation of groups of cars-good access to high-speed trains used for combined transportation.
11.the requirements for intermediate stations listed below also apply to terminals.
E. minimum requirements for intermediate stations
12.stops on the tracks of trains used for combined transportation should be used simultaneously for technical or operational reasons, for example, for replacing a group of cars at stations or replacing a pair of wheels, in the opposite case, for carrying out works that require additional stops (i.e. for border control, locomotive replacement).
The infrastructure of such intermediate stations must meet the conditions listed below:
- Access roads must have sufficient daily capacity to prevent train delays used for combined transportation.
- Access to and exit from access roads should ensure the smooth movement of trains in both directions. Their carrying capacity should be sufficient to prevent delays in arriving and/or departing trains used for combined transportation.
- Various models of tracks must have a throughput capacity for carrying out specific work at stations, which applies, in particular, to receiving and dispatching tracks, collection tracks, sorting lines and shipments, loading tracks and even wheel replacement tracks.
- The above loading volumes must correspond to the loading volumes for use on railway lines (ITU B or ITU c).
- The length of the tracks should be sufficient to accommodate full-line trains used for combined transportation.
- In the case of using electric traction, the tracks must be accessible for electric locomotives (at border stations for electric locomotives on the corresponding adjacent tracks).
-Capacity for transshipment, exchange of groups of cars, replacement of wheel sets, as well as means of customs control should ensure the minimum duration of the necessary parking.
a) Exchange stations with groups of wagons
13.combined transportation between Departure and arrival stations should be carried out, if possible, by direct trains. If this is economically inappropriate due to the small volume of shipments, and if the loading and unloading of combined shipments is inevitably necessary in this regard, they must be carried out by a group of wagons, even if they are not. The duration of stops for these operations should not exceed 30 minutes in each case. This could be achieved through the formation of appropriate trains (the length of their route should be as high as possible, including crossing borders), along with the creation of an adequate infrastructure of exchange stations with groups of cars.
b) border posts
14.trains used for combined transportation, if possible, must travel along all routes to the station where it is necessary to exchange groups of cars, crossing the borders or to the final point without stopping on the way. Stops at the borders should be excluded, if possible, and if not, their duration should be insignificant (no more than 30 minutes). This includes:
- by abandoning the work normally carried out at the border or, if this is not possible, by doing it at internal points where trains have to stop in any case for reasons of a technical and/or administrative nature;
- it should be achieved by making a single stop or by completely abandoning stops at border stations in general.
C) stations for changing wheel pairs
15.in order to meet the requirements in the future, it is necessary to develop effective procedures in terms of time and costs. With regard to the transshipment of cargo units to other track wagons, the above requirements for transshipment at terminals must also apply. At such stations, the duration of stops for changing wheel pairs should be as small as possible. Available means for replacing or reloading wheel sets should be sufficient to ensure a small length of parking.
d) railway / ferry crossings
16.general conditions of Transportation must comply with the contract of transportation by ferries. For combined transportation, the duration of stops at berths should be as small as possible (preferably not more than 1 hour). In addition to the creation of appropriate station infrastructure and appropriate ferry vessels in ferry ports (see paragraph 17 below), this can be done with the help of the following measures:
- Application of the requirements for the necessary border control measures mentioned in paragraph 14;
- coordination of traffic schedules at ferry crossings and railways and timely provision of information for the purpose of loading ships and/or formation of formations.
17. ferry vessels used for combined transportation must meet the following requirements:
- the volume and types of vessels must correspond to the transported cargo units and wagons;
-fast loading and unloading of ferry vessels, as well as storage of cargo units/wagons in accordance with the requirements of the following railway transportation (if necessary, distribution of combined transportation and passenger and/or road transportation);
- if cargo units remain in wagons during transportation, then ferry ships should be easily accessible, while eliminating the need to carry out sorting operations that require large time costs. The volume of loading, the load on the shaft, etc.must correspond to the indicators for the lines given in Annex III;
- if it is necessary to load and unload cargo units separately from cars, then there should be the shortest and most reliable highways for the implementation of road transport, which can be between ferries and railway terminals.
