The petition
on participation in the preliminary examination of the application
On September 12, 2023, Plaintiff A.A.E. filed a petition for a cassation review of the decision of the Saryarkinsky District Court of Astana dated February 22, 2023 and the Decision of the Judicial Board for Civil Cases of the Astana City Court dated June 2, 2023. The petition was registered under No. 6001-23-00-3G/4332(3) dated 09/13/2023.
Dear Court, for the purposes of a comprehensive, complete and objective consideration of the civil case by the court, namely, as part of the preliminary consideration of the petition, the plaintiff's representative and a third party, A.E., must participate in the courtroom. The plaintiff's representative will participate via mobile communication (WhatsApp Messenger), and the third party A.E. wishes to participate in a generally established mode (offline), after which the court will be provided with evidence (original documents) that may affect the content of the decision.
Based on the above and guided by art. 46 of the CPC RK,
I ASK THE COURT:
To allow the Plaintiff's representative to attend the court hearing as part of the preliminary consideration of the petition using the WhatsApp mobile application;
To allow a third person A.E. to take part in the court session as part of the preliminary consideration of the petition in a generally established mode (offline).
