The petition
on the withdrawal of the complaint filed in accordance with Article 106 of the Criminal Procedure Code of the Republic of Kazakhstan
In your proceedings, there are materials of case No. 7595-24-2-5/1027 filed in accordance with Article 106 of the Criminal Procedure Code of the Republic of Kazakhstan, on the complaint of K.N.Zh. about leaving his Application for a criminal offense without consideration and writing it off to the nomenclature proceedings.
After the court reviewed our complaint by the pre-trial investigation authorities, our application was registered by ERDR No. 247514031000958 dated 06/11/2024 upon the commission of a crime under art. 190 Part 1 of the Criminal Code of the Republic of Kazakhstan.
In accordance with paragraph 5 of Article 100 of the CPC of the Republic of Kazakhstan, the person who filed the complaint has the right to withdraw it. The suspect or the accused has the right to withdraw the complaint of the defender; the civil plaintiff, the victim (private prosecutor), the civil defendant has the right to withdraw the complaint of his representative, except for the legal representative. A complaint filed in the interests of a suspect or an accused may be withdrawn only with their consent. The withdrawal of the complaint does not prevent its re-filing before the expiration of the time limits specified in Article 102 of this Code, except in cases expressly provided for by this Code.
Based on the above and in accordance with paragraph 5 of Article 100 of the Criminal Procedure Code of the Republic of Kazakhstan,
I ask the court:
· The complaint of K.N.Zh. registered under No. 7595-24-2-5/1027 about leaving his Application for a criminal offense without consideration and writing it off to the nomenclature production should be returned and left without examination.
