The petition
on the unification of civil cases
In your proceedings, there is a civil case registered No. 7527-24-00-2/2745 on the claim of the Limited Liability Partnership of T.S. LLP (hereinafter referred to as the Plaintiff) against M.B.G. LLP (hereinafter referred to as the Defendant) for the recovery of the amount under the contract of 2,200,000 tenge.
In addition, in the Specialized Interdistrict Economic Court of Almaty, Judge Turalieva A.S. has a civil case No. 7527-24-00-2/2627 on the claim of the Limited Liability Partnership LLP "T...S" to LLP "M.B.G." for the recovery of the amount under the contract of 250,000 tenge.
The above-mentioned civil cases are filed against the same persons, moreover, they are closely interrelated.
We believe that combining these cases into one proceeding will contribute to the proper and timely resolution and consideration of the merits of the dispute.
According to paragraph 3 of Article 167 of the CPC RK, a judge, having established that there are several homogeneous cases in the proceedings of this court involving the same parties, or several cases involving claims by one plaintiff against different defendants or different plaintiffs against the same defendant, has the right to combine these cases at his discretion or at the request of the parties to one proceeding for joint consideration, if it recognizes that such a combination would be appropriate.
Based on the above and guided by art.167 of the CPC RK,
I ask the Court:
To combine the civil cases registered registered No.7527-24-00-2/2745 on the claim of the Limited Liability Partnership of T...S LLP (hereinafter referred to as the Plaintiff) to M.B.G. LLP (hereinafter referred to as the Defendant) for the recovery of the amount under the contract of 2,200,000 tenge with the Civil Case No. 7527-24-00-2/2627 on the claim of the Limited Liability Partnership LLP "T..S" to LLP "M.B.G." on the recovery of the amount under the contract of 250,000 tenge.
