On the ratification of the Treaty between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation of the Kazakh-Turkmen State Border

     To ratify the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation of the Kazakh-Turkmen State Border, signed in Astana on July 5, 2001.

     The Republic of Kazakhstan and Turkmenistan, hereinafter referred to as the High Contracting Parties, reaffirming their desire to build their interstate relations in the spirit of friendship and good-neighborliness, based on respect, mutual understanding, as well as the principles of sovereign equality, territorial integrity, inviolability of existing borders, justice, non-interference in internal affairs, emphasizing their commitment to the norms of international law, first of all, to the purposes and principles of the Charter of the United Nations, and following the obligations of, adopted within the framework of the Organization for Security and Co-operation in Europe, in accordance with the Treaty on Friendly Relations and Cooperation between the Republic of Kazakhstan and Turkmenistan dated May 19, 1993, the Memorandum on the Delimitation of the State Border between the Republic of Kazakhstan and Turkmenistan dated April 9, 1999, confirming the absence of territorial issues to each other,         Taking into account the need to clarify and formalize the passage of the state border line between the Republic of Kazakhstan and Turkmenistan in order to ensure its inviolability and inviolability, emphasizing that the state border between the Republic of Kazakhstan and Turkmenistan will always be the border of peace and harmony between the States of the two fraternal peoples, agreed as follows:  

  Article 1  

     The High Contracting Parties have determined the line of the Kazakh-Turkmen state border (hereinafter referred to as the state border) on the basis of the administrative-territorial delimitation of the former Kazakh SSR and the Turkmen SSR.  

  Article 2  

     The High Contracting Parties have agreed that the State border line between the Republic of Kazakhstan and Turkmenistan runs in full accordance with the Description of the State border line between the Republic of Kazakhstan and Turkmenistan, which is an integral part of this Treaty (Annex 1).  

  Article 3  

     The State border line is plotted on 1:100,000 scale map sheets, which are an integral part of this Agreement (Appendix 2).  

  Article 4  

     Any natural changes in the terrain do not entail changes in the course of the State border line, unless the High Contracting Parties agree otherwise.  

  Article 5  

     The border on the Caspian Sea will be determined by a separate agreement between the Republic of Kazakhstan and Turkmenistan.  

  Article 6  

     The junction point of the state borders of the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan will be determined by a separate international agreement between these states.  

  Article 7  

     The High Contracting Parties agreed to start the process of demarcation of the Kazakh-Turkmen state border.  

  Article 8  

     Any issues regarding the interpretation and application of the provisions of this Agreement will be settled through negotiations and consultations.  

  Article 9  

     This Agreement is open-ended and is not subject to denunciation.         This Treaty is subject to ratification and shall enter into force on the date of the exchange of instruments of ratification.  

     Done in Astana, July 5, 2001, in two original copies, each in the Kazakh, Turkmen and Russian languages, all texts being equally authentic.         For the purposes of interpreting the provisions of this Agreement, the text in Russian will be used.

 Annex 1 to the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation Process of the Kazakh-Turkmen Border      state borders      

  Description of the state border line between the Republic of Kazakhstan and Turkmenistan  

     The starting point of the Kazakh-Turkmen state border (hereinafter referred to as the state border line) is the junction point of the state borders of the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan. This point will be determined by a separate international agreement between the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan.         From the starting point, the state border line runs in a straight line in a westerly direction to the border point No. 1.         Boundary point No. 1 is located on the K-40-100 map sheet (state of the area in 1974, edition of 1984) with coordinates X = 4,576,660, Y = 10,416,000 and is located 10.40 km northeast of the geodetic point with a mark of 13.2, 8.97 km north of the unpaved a reference point with a minus 30.7 mark.         From border point N 1, the state border line runs in a straight line in a westerly direction to border point N 2. The length of the state border line between border points N 1 and N 2 is 10.46 km.        

Boundary point No. 2 with coordinates X = 4,577,605, Y = 10,405,608 is located at the intersection of the state border line with a field road, 9.31 km north-northwest of the geodetic point with a mark of 13.2, 8.12 km east of the dirt reference point with a mark of 209.9.        

From border point N 2, the state border line runs along a field road in a general southwesterly direction to border point N 3. The length of the state border line between border points N 2 and N 3 is 8.20 km.         Boundary point No. 3 with coordinates X = 4,572,405, Y = 10,400,410 is located at the intersection of the state border line with a field road, 9.30 km west-northwest of the geodetic point with a mark of 13.2, 8.24 km north of the geodetic point with a mark of 37.2, 4.69 km south-northwest of the geodetic point with a mark of 37.2.east of the ground reference point with a mark of 209.9.        

From border point N 3, the state border line runs in a general west-northwesterly direction through an elevation of 177.6 to border point N 4. The length of the state border line between border points N 3 and N 4 is 3.40 km.         Boundary point No. 4 with coordinates X = 4,573,114, Y = 10,397,090 is located on the upper edge of the Chinka Kaplankyr cliff, 9.32 km north-northwest of the geodetic point with a mark of 37.2, 9.73 km northeast of the geodetic point with a mark of 34.6, 3.17 km south from the ground reference point with a mark of 209.9.        

From border point No. 4, the state border line runs along the upper edge of the Chinka Kaplankyr cliff in a general westerly direction, then goes to the map sheet K-40-99 (state of the area in 1974, edition of 1984) and then goes in a general northwesterly direction, goes to the map sheet K-40-87 (the state of the area in 1990, 1991 edition) and goes in a general northwesterly direction to the border point N 5. The total length of the state border line between border points N 4 and N 5 is 81.00 km.        

Boundary point No. 5 with coordinates X = 4,579,890, Y = 10,364,150 is located at the intersection of the upper edge of the Chinka Kaplankyr cliff with a field road, 6.20 km west of the geodetic point with a mark of 241.7, 0.62 km north-northwest of the ground reference point with a mark of 192.5, 3.82 km to the south-southeast of the geodetic point with the mark 239.3.       

 From border point No. 5, the state border line runs along the field road in a general north-northwesterly direction, crossing the field road at 11.00 km, goes through a dirt marker at 264.9, crossing the field road at 17.50 km, goes through a point at 242.6 and Deneli well, crossing the field road at a point marked 220.3, goes through the point with the mark 213.4 and goes to the map sheet K-40-75 (state of the area in 1963, edition of 1972). Then the state border line runs in a general north-northwesterly direction along the field road, crossing the field road at 50.30 km, goes through the Kyrksekiz well, crossing the field road at a point with a mark of 214.0, crossing the field road at 58.30 km, goes to the map sheet K-40-74 (the state of the area in 1960, 1972 edition). Next, the state border line runs along a field road in a general north-northwesterly direction through a point with a mark of 184.0 and the Koshadzhi well, then goes in a northwesterly direction along a field road through the geodetic point Koshkui North. at the 193.8 mark, crossing the field road at 82.50 km, it goes to the K-40-62 map sheet (state of the area in 1979, edition of 1985). Further, the state border line runs in a general north-westerly direction along the field road through the Urakkazgan-Kurluk well to border point No. 6. The total length of the state border line between border points No. 5 and No. 6 is 92.50 km.        

From border point No. 6, the state border line runs in a straight line in a northwesterly direction to border point No. 7. The length of the state border line in this section is 5.15 km.         Boundary point No. 7 with coordinates X = 4,660,080, Y = 10,316,190 is located at the Kopkuduk wells, 7.20 km west of the geodetic point Ushkuduk East. with a mark of 178.4, 1.66 km east of the geodetic point Ushkuduk with a mark of 199.7, 6.72 km east-northeast of the ground reference with a mark of 201.4.        

From border point No. 7, the state border line runs in a straight line in a northwesterly direction, crossing field roads at 11.00 km, 19.46 km and 25.26 km, goes to the map sheet K-40-61 (state of the area in 1981, edition of 1985), then goes in a straight line in a northwesterly direction crossing the field roads at 35.55 km and 44.38 km, goes to the map sheet K-40-49 (state of the area in 1989, 1994 edition), then goes in a straight line in a northwesterly direction, crossing the field road at 50.81 km, to the border point N 8. The total length of the state border line between border points N 7 and N 8 is 58.75 km.        

Boundary point No. 8 is located at the Baskarasai well, 3.41 km west-northwest of the geodetic point with a mark of 131.0, 2.97 km north of the geodetic point with a mark of 110.9, 2.64 km south-southwest of the geodetic point with a mark of 109.2.        

From border point No. 8, the state border line runs in a straight line to the west, crossing field roads at 0.97 km, 4.40 km and 14.55 km, goes to the map sheet K-39-60 (state of the area in 1988, edition of 1989), then goes in a straight line to the west, crossing field roads at 18.79 km and 26.50 km, goes to the map sheet K-39-72 (the state of the area in 1988, 1992 edition), then goes in a straight line in a westerly direction, crossing field roads at 28.10 km, 31.01 km and 33.72 km, goes through the Chagillyshor depression, then goes, crossing field roads for 46.58 km and 52.09 km, to the border point N 9. The total length of the state border line between border points No. 8 and No. 9 is 54.17 km.        

Boundary point No. 9 is located at the Kyrkkulach well in the Karynzharyk sands, 1.81 km south-southeast of the Kyrkkulach geodetic point with a mark of 133.0, 8.33 km north of the geodetic point on the Karynzharyk hill with a mark of 168.1, 6.96 km west of the ground reference point with a mark of 44.7.         From border point No. 9, the state border line runs in a straight line in a west-southwesterly direction and passes to the map sheet K-39-71 (state of the area in 1988, edition of 1989). Then the state border line runs in a straight line in a west-southwesterly direction, crossing field and country roads for 10.14 km, 16.67 km, 16.95 km, 19.90 km, 28.04 km, 33.74 km, 35.04 km, 35.92 km, 40.82 km, 45.44 km and 47.80 km, goes to the map sheet To-39-70 (the state of the area in 1988, 1989 edition), then goes in a straight line in a west-south-westerly direction, crossing the field road at 51.20 km, to the border point N 10. The total length of the state border line between border points N 9 and N 10 is 52.17 km.         Boundary point No. 10 with coordinates X = 4,667,154, Y = 9,664,078 is located at a geodetic point with a mark of 139.9, 7.81 km east-southeast of the geodetic point Karakabak with a mark of 160.7, 8.41 km north of the geodetic point with a mark of 128.6.        

From border point No. 10, the state border line runs in a straight line in a southwesterly direction, crossing field roads for 0.30 km, 4.35 km and 6.50 km, to border point No. 11. The length of the state border line between border points N 10 and N 11 is 6.80 km.         Boundary point No. 11 with coordinates X = 4,62,758, Y = 9,658,878 is located at a geodetic point with a mark of 164.4, 6.98 km south-southeast of the geodetic point Karakabak with a mark of 160.7, 5.95 km northwest of the geodetic point with a mark of 128.6.        

From the border point No. 11, the state border line runs in a straight line in a southwesterly direction, crossing field roads for 0.53 km, 2.20 km, 2.77 km, 6.77 km, 7.11 km, 8.50 km and 13.10 km, passes to the map sheet K-39-82 (state of the area in 1977, edition 1985 year), then goes in a straight line in a southwesterly direction, crossing field roads for 16.10 km, 19.15 km, 21.57 km and 23.83 km, to the border point N 12. The total length of the state border line between border points N 11 and N 12 is 24.30 km.         The boundary point N 12 with coordinates X = 4,646,136, Y = 9,641,257 is located at a geodetic point with a mark of 124.0 on Dalia Mountain, 9.20 km west of the geodetic point with a mark of 106.2, 7.58 km west of the geodetic point with a mark of 99.9.        

From the border point N 12, the state border line runs in a straight line in a southwesterly direction, crossing the gas pipeline for 4.06 km, as well as field and country roads for 4.90 km, 9.20 km, 14.47 km, 16.50 km and 21.35 km, goes to the map sheet K-39-81 (state of the area in 1977, 1985 edition), then goes in a straight line in a southwesterly direction, crossing field roads for 24.90 km and 27.42 km, to the border point N 13. The total length of the state border line between border points N 12 and N 13 is 28.90 km.         The boundary point N 13 with coordinates X = 4,626,285, Y = 9,620,270 is located 3.41 km west-northwest of the geodetic point with a mark of 39.8 on Mount Ilgildykair, 4.08 km west of the geodetic point with a mark of 46.5, 4.00 km south-southwest of the geodetic point item with a mark of 23.3.        

The total length of the described state border line between the Republic of Kazakhstan and Turkmenistan is 425.80 km.         The described state border line is marked in red on the 1:100,000 scale map sheets indicated in the text. All distances and coordinates are measured using these maps graphically. The spelling of geographical names in Russian used in the Description text corresponds to the above maps.
