On the Ratification of the Protocol to the Agreement on the Amount of State Duty and the Procedure for its Collection in the Consideration of Economic Disputes between Business Entities of Different States

       To ratify the Protocol to the Agreement on the Amount of State Duty and the Procedure for its Collection in the Consideration of Economic Disputes between Business Entities of Different States dated December 24, 1993, concluded in Minsk on June 1, 2001.

It comes into force from the moment of its signing, and for States whose legislation requires the implementation of domestic procedures, from the date of transfer of the relevant documents to the depositary.

The Republic of Belarus - deposited on July 10, 2001; the Republic of Azerbaijan - deposited on July 10, 2001 (on the need to comply                                      internal procedures); The Republic of Armenia - deposited on December 28, 2001; the Kyrgyz Republic - deposited on March 4, 2002 (on the need to comply with                                      domestic procedures);   Russian Federation - deposited on November 16, 2002; Republic of Tajikistan - deposited on November 26, 2002; Republic of Kazakhstan - deposited on December 16, 2002; Republic of Moldova - deposited on December 23, 2002; Kyrgyz Republic - deposited on January 17, 2006.  

The Protocol entered into force from the moment of signing.

The Republic of Belarus - June 1, 2001 (from the moment of signing); the Republic of Armenia - December 28, 2001; the Russian Federation - November 16, 2002; the Republic of Tajikistan - November 26, 2002; the Republic of Kazakhstan - December 16, 2002; the Republic of Moldova - December 23, 2002; the Kyrgyz Republic - January 17, 2006.  

Note:  

The depositary has not received a notification from Georgia about the need to carry out internal procedures or about the absence of the need to carry them out.  

     The States Parties to the Agreement on the Amount of State Duty and the Procedure for its Collection when Considering Economic Disputes between Business Entities of Different States dated December 24, 1993, agreed to amend article 2 of the said Agreement, stating it as follows:  

"Article 2  

     In order to ensure equal opportunity for judicial protection of the rights and legitimate interests of economic entities located on the territory of different states in dispute resolution, establish the following rates of state duty when applying to a court of another state with a claim price (in rubles of the Russian Federation):  

up to 10 thousand rubles - 3 percent of the claim price;  

over 10 thousand rubles to 50 thousand - 300 rubles + 2.5 percent rubles of the amount over 10 thousand rubles;  

over 50 thousand rubles to 100 thousand - 1 thousand 300 rubles + 2 rubles percent of the amount over 50 thousand rubles;  

over 100 thousand rubles to - 2 thousand 300 rubles + 1.5 500 thousand rubles as a percentage of the amount over 100 thousand rubles;  

over 500 thousand rubles to -8 thousand 300 rubles + 1 percent of 1 million rubles of the amount over 500 thousand.                                        rubles';  

over 1 million rubles - 13 thousand 300 rubles + 0.5 percent of the amount over 1 million rubles.  

     A non-property claim is charged 500 rubles if the legislation of the state where the claim is filed does not establish a lower amount of state duty."             This Protocol shall enter into force from the moment of its signature, and for States whose legislation requires the implementation of domestic procedures, from the date of transfer of the relevant documents to the depositary.         Done in Minsk on June 1, 2001, in one original copy in the Russian language. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Protocol.

     I hereby certify that the attached text is an authentic copy of the Protocol to the Agreement on the Amount of State Duty and the Procedure for its Collection in the Consideration of Economic Disputes between Business Entities of Different States dated December 24, 1993, adopted at the meeting of the Council of Heads of State of the Commonwealth of Independent States, which was held on June 1, 2001 in Minsk. The original copy of the above-mentioned Protocol is kept in the Executive Committee of the Commonwealth of Independent States.
