On the ratification of the Memorandum of Understanding between the Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia

To ratify the Memorandum of Understanding between the Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia, signed in Riyadh on November 8, 1999.

Based on the principle of cooperation between the Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia and taking into account the development needs of Astana, the new capital of Kazakhstan. Based on the decision of the King of Saudi Arabia to allocate a grant of 15 million US dollars for the construction of the Parliament building of the Republic of Kazakhstan in the new capital of Astana. Taking into account the results of the meeting held on July 21-29, 1999 (which corresponds to the 8th-16th of the month). Rabia al-Sani (1420 AH) traveled to Kazakhstan by the technical group of the Ministry of Finance and National Economy of the Kingdom of Saudi Arabia, which got acquainted with the location of the project, studied its needs, and met with those responsible for the project. Based on the desire to streamline the activities that are necessary for the implementation of the project.
The Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia have reached an understanding on the following issues:
1. In accordance with the decision of the leadership of Kazakhstan, in order to use the infrastructure of the existing building, the project will be carried out on the site on the north side of the existing Parliament building along Omarova Street near its intersection with Beibitshilik Street.
2. The project will be implemented within the framework of the allocated grant on a plot of land allocated by the customer, while the Ministry of Finance and National Economy of the Kingdom of Saudi Arabia (hereinafter referred to as the Ministry) performs the following works: - preparation of drawings, descriptions, primary and final schemes, documentation related to the project; technical management of the project implementation through the Saudi Engineering Consulting Bureau in accordance with the terms of reference submitted by the Kazakh side during the visit of the technical group, and based on the consent of the Kazakh side with the primary schemes of the project; - putting the project up for tender between several specialized companies identified by the Ministry in order to provide the project to the company that has put forward the most acceptable conditions; - allocation of funds by the Ministry for the implementation of the project in the course of work on it in accordance with the contractor's reports approved by the consultant.
3. Considering the desire of the Kingdom of Saudi Arabia to implement the project properly, the Government of the Republic of Kazakhstan:
3.1 - Freely allocate a plot of land for the implementation of the project.
3.2 - Take the necessary measures to exempt the materials required for the implementation of the project from licensing, customs duties, warehouse and import duties, as well as all direct and indirect taxes on all materials, equipment, machinery, technical personnel and everything necessary for the implementation of the project. Will take measures for the early customs clearance of the specified materials. If, for any reason, this proves impossible and any taxes or fees are required, the Government of Kazakhstan will make all necessary payments to clean up the materials as soon as possible as soon as they arrive.
3.3 - Will provide all possible benefits to the contractor carrying out the project, exempt him from all taxes and fees applicable in the customer's country related to the contractor's activities, as well as those related to his employees and workers, persons and companies with whom the contractor enters into contracts for the implementation of the project.
3.4 - Will provide assistance to persons working in the Consulting Bureau who prepare projects and schemes and manage the implementation of the project; will issue all necessary permits for the Bureau and its staff to carry out work on the project.
3.5 - Instructs the Mayor of Astana to communicate with the Saudi side.
3.6 - Agrees to install a stationary banner of the appropriate size in a prominent place on the site, which will indicate in Arabic and Kazakh that this project is being implemented at the expense of a grant provided by the Kingdom of Saudi Arabia.
This Memorandum comes into force from the moment of signing. Signed in Riyadh, November 8, 1999, which corresponds to 30 Rajab 1420 AH, in two original copies, each in Kazakh, Arabic, Russian and English, and all texts are equally authentic. In case of any disagreement, the English text will be used as the basis.
