On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the International Center for the Improvement of Corn and Wheat on cooperation in the field of agricultural science

To ratify the Agreement between the Government of the Republic of Kazakhstan and the International Center for the Improvement of Corn and Wheat on cooperation in the field of agricultural science, signed in Basel on September 8, 1999.        President of the Republic of Kazakhstan                                 Agreement between the Government of the Republic of Kazakhstan and the International Center for the Improvement of Corn and Wheat on cooperation in the field of agricultural science

          The Government of the Republic of Kazakhstan and the International Corn and Wheat Improvement Center (CIMMYT), hereinafter referred to as the "Parties", expressing their mutual desire to develop cooperation in the field of agricultural science, convinced that this cooperation will contribute to the progress of agriculture, increase soil fertility, plant and animal productivity, in order to create favorable conditions for the activities of CIMMYT to increase agricultural production, preserve plant genetic resources, environmental protection in the Republic  Kazakhstan, through attracting foreign investments in agricultural science, using the experience of international scientific centers, supplying modern instruments and equipment, and training scientific personnel, have agreed as follows:                                                              

 

Article 1 In order to achieve fruitful cooperation, the Parties will carry out: a) exchange of scientists, specialists and advanced technologies; b) exchange of germplasm and breeding material in accordance with the current legislation of the Republic of Kazakhstan and International  Convention on Biological Diversity; c) exchange of scientific literature, information and methodology; d) import and export of items related to the joint research program.                                                              

 

Article 2            Within the limits of human and budgetary capabilities, SIMBIT will provide:           a) consultations of staff members of SIMMIT and other international research organizations to assist and improve the level of national scientific research in the Republic of Kazakhstan; b) services of foreign scientists, if necessary, for the implementation of research programs. The procedure for entry and stay of foreign scientists in the territory of the Republic of Kazakhstan is regulated by the current legislation of the Republic of Kazakhstan;           c) scholarships for internships of Kazakhstani scientists and specialists of various levels of education and financial support for their participation in symposiums, seminars and conferences related to topics of mutual interest; d) seed material in quantities necessary for experiments, large-scale production testing and demonstrations; e) research subjects, literature and equipment.                                                              

 

Article 3            The Government of the Republic of Kazakhstan, within the limits of its personnel and budgetary capabilities, will provide:           a) by mutual agreement - office premises, laboratories, scientific and technical staff and experimental sites for scientific activities within the framework of joint programs; b) ensuring customs control at the entrance to the Republic of Kazakhstan of trainees and scientists associated with the SYMMITa program;           c) in accordance with the current legislation of the Republic  Kazakhstan and the norms of international law agree to the unhindered movement of germplasm through the territory of the Republic of Kazakhstan and export from the Republic of Kazakhstan, if necessary for joint programs, to any part of the world in compliance with mandatory quarantine inspection in order to avoid the import or export of dangerous pests and diseases.  The Government of the Republic of Kazakhstan agrees to ensure timely and expedited inspection of all materials.                                                             

 

Article 4            The Government of the Republic of Kazakhstan agrees to grant CIMMITA employees who are not citizens of the Republic of Kazakhstan and do not permanently reside on its territory the status of seconded experts with the rights and privileges necessary for them to perform their functions, namely: a) multiple-entry visas and residence permits for them and their family members for the period necessary to perform their work, in accordance with the current legislation of the Republic of Kazakhstan;           b) exemption from payment of import duties and taxes levied in the Republic of Kazakhstan on the import of personal and household items, including one passenger car per family, without the right to sell without the permission of customs authorities. These personal and household items may be either exported or transferred to other persons in the Republic of Kazakhstan in accordance with the current legislation of the Republic of Kazakhstan.                                                             

Article 5            The Government of the Republic of Kazakhstan according to:           a) for the customs clearance of property necessary for the implementation of joint programs in the temporary import/export regime in accordance with the customs legislation of the Republic of Kazakhstan; b) in case of alienation of property imported under the obligation of re-export, measures provided for by the current legislation of the Republic of Kazakhstan are applied without the permission of the customs authorities of the Republic of Kazakhstan.                                                              

Article 6 CIMMYT will carry out activities on the territory of the Republic of Kazakhstan provided for by its Charter and not contradicting the current legislation of the Republic of Kazakhstan.           SIMBIT will perform financial and currency transactions in accordance with the current legislation of the Republic of Kazakhstan.                                                              

Article 7            The parties agreed that:           a) useful results, such as improved breeding material, technical developments and methods created jointly, can be used equally by both Parties, unless otherwise stipulated by an additional agreement; b) scientific results will be published in the public interest by mutual agreement with mandatory reference to co-executors.                                                              

Article 8            The Parties agreed to establish an Advisory Council to develop specific details of cooperation between the two Sides in order to ensure the effective implementation of this Agreement.           The procedure, terms of establishment, composition and functions of the Advisory Council will be determined by the competent authorities appointed by the Parties.                                                              

Article 9            The parties agreed to open a representative office of CIMMITa in Central Asia and Transcaucasia in Almaty.                                                              

Article 10            The Parties may, by mutual agreement, make amendments and additions to this Agreement, which are formalized by the relevant protocol, which is an integral part of it.                                                              

Article 11 Disputes between the Parties that may arise in connection with the application or interpretation of this Agreement will be resolved through consultations and negotiations between the Parties.                                                             

Article 12 This Agreement shall enter into force on the date of receipt by the Parties of written notifications confirming the completion of the relevant domestic procedures necessary for its entry into force.          

 

This Agreement is concluded for a period of five years and will be

automatically extended for subsequent five-year periods if neither Party notifies the other six months before the expiration date.  Of the Agreement in writing about its intention to terminate it.       Done in Basel on September 8, 1999, in two originals, each in the Kazakh, English and Russian languages, all texts being equally authentic.
