On the introduction of a state of emergency in the West Kazakhstan region
Decree of the President of the Republic of Kazakhstan dated January 5, 2022 No. 740.
In order to ensure the safety of the population of the West Kazakhstan region, in accordance with subparagraph 16) of Article 44 of the Constitution of the Republic of Kazakhstan and articles 4, 5, 6 of the Law of the Republic of Kazakhstan "On the State of Emergency", I DECREE:
1. In connection with a serious and immediate threat to the safety of citizens, in order to ensure public safety, restore law and order, and protect the rights and freedoms of citizens, a state of emergency should be imposed within the borders of the West Kazakhstan region for the period from 9:30 p.m. on January 5, 2022, until 00:00 a.m. on January 19, 2022.
2. To introduce a curfew in the West Kazakhstan region for the duration of the state of emergency from 23:00 to 7:00.
3. To create the commandant's office of the West Kazakhstan region for the period of the state of emergency and to give it the powers provided for by the Law of the Republic of Kazakhstan "On the State of Emergency".
Appoint Mahsudkhan Nugmanovich Ablazimov, Head of the Police Department of the West Kazakhstan region, as the commandant of the West Kazakhstan region.
4. To introduce the following measures and time restrictions for the duration of the state of emergency:
1) strengthen the protection of public order, the protection of particularly important state and strategic facilities, as well as facilities that ensure the livelihoods of the population and the functioning of transport;
2) to establish restrictions on freedom of movement, including vehicles, in the West Kazakhstan region;
3) ensure the verification of identity documents of individuals, personal inspection, inspection of their belongings, vehicles;
4) restrict entry to and exit from the West Kazakhstan region;
5) prohibit the organization and holding of peaceful assemblies, entertainment, sports and other mass events;
6) prohibit strikes and other ways of suspending or terminating the activities of legal entities;
7) prohibit the sale of weapons, ammunition, explosives, special equipment, toxic substances, establish a special regime for the turnover of medicines, narcotic drugs, psychotropic substances, precursors, as well as ethyl alcohol, alcoholic products;
8) ensure the temporary seizure of weapons and ammunition, and toxic substances from individuals, and the temporary seizure of military and training equipment, explosives, and radioactive substances from legal entities, along with weapons, ammunition, and toxic substances.
5. To identify the Commandant's Office of the West Kazakhstan region, the Ministry of Internal Affairs of the Republic of Kazakhstan, the National Security Committee of the Republic of Kazakhstan, the Ministry of Defense of the Republic of Kazakhstan, and the Ministry of Emergency Situations of the Republic of Kazakhstan as responsible for the implementation of measures applied under the state of emergency.
6. The Prosecutor General of the Republic of Kazakhstan shall ensure the observance of legality in the implementation of measures and time limits established by this Decree.
7. The Government of the Republic of Kazakhstan should allocate the necessary funds from the reserve of the Government of the Republic of Kazakhstan to ensure the state of emergency.
8. This Decree shall enter into force from the date of signing.
