On the approval of the Consular Charter of the Republic of Kazakhstan

In accordance with the second part of subparagraph 14) of Article 1 of the Law of the Republic of Kazakhstan "On the Diplomatic Service of the Republic of Kazakhstan", I HEREBY DECREE:

1. To approve the attached Consular Charter of the Republic of Kazakhstan.
2. To invalidate certain decrees of the President of the Republic of Kazakhstan in accordance with the annex to this Decree.
3. This Decree shall enter into force from the date of its signing.

Consular Charter of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Consular Charter of the Republic of Kazakhstan (hereinafter referred to as the Charter) defines the legal basis of the consular service of the Republic of Kazakhstan, the rights and obligations of consular officials of the Republic of Kazakhstan to protect the rights and interests of the Republic of Kazakhstan, citizens and legal entities of the Republic of Kazakhstan outside the Republic of Kazakhstan.
The following concepts are used in this Charter:
1) the state of residence is a foreign state in the territory of which the foreign institution of the Republic of Kazakhstan is located.;
2) consular archive – documents, correspondence, audio and video materials, electronic media, books, magazines, registers, card files, ciphers, codes, seals, stamps and other items intended for the performance of consular functions;
3) Consular institution is a foreign institution of the Republic of Kazakhstan that performs consular functions on behalf of the Republic of Kazakhstan within a certain consular district.;
4) the head of the consular institution is an employee of the diplomatic service of the Republic of Kazakhstan, who heads the consular institution.;
5) The class of a consular institution is the status of a consular institution determined by the Republic of Kazakhstan in agreement with the host state, depending on its socio–economic, political significance and its location in the host state.;
6) consular district – the territory allocated to the consular institution of the Republic of Kazakhstan (hereinafter referred to as the consular institution) for the performance of consular functions;
7) A consular official of the Republic of Kazakhstan (hereinafter referred to as a consul) is an employee of the diplomatic service of the Republic of Kazakhstan who performs consular functions on behalf of the Republic of Kazakhstan within the consular district.;
8) honorary (non–staff) Consul of the Republic of Kazakhstan (hereinafter – honorary consul) is a person who heads the honorary Consulate of the Republic of Kazakhstan (hereinafter – honorary consulate), who is not in the civil service of the Republic of Kazakhstan, who is entrusted with performing consular functions on behalf of the Republic of Kazakhstan on the territory of a foreign state within the consular district.

2. The Consular Service of the Republic of Kazakhstan is a part of the diplomatic service, whose activities are aimed at ensuring the protection of the rights and interests of the state, citizens and legal entities of the Republic of Kazakhstan within the limits permitted by international law, as well as to promote the development of friendly relations between the Republic of Kazakhstan and other states and the expansion of economic, trade, scientific, technical, humanitarian and cultural ties. and cooperation in the field of tourism.

3. The consular service of the Republic of Kazakhstan is carried out in accordance with the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On the Diplomatic Service of the Republic of Kazakhstan", this Charter, other regulatory legal acts, taking into account the legislation of the host state, as well as international treaties of the Republic of Kazakhstan, generally recognized principles and norms of international law.

4. In States where there are no diplomatic or equivalent representative offices of the Republic of Kazakhstan (hereinafter referred to as diplomatic missions), the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter referred to as the Ministry) may assign diplomatic functions to the head of the consular institution with the consent of the receiving State.

5. The National Flag of the Republic of Kazakhstan must be hoisted on the buildings of consular offices and the National Emblem of the Republic of Kazakhstan must be placed.

6. The consular institution shall have a seal with the image of the State Emblem of the Republic of Kazakhstan and the name of the consular institution in the official language of the Republic of Kazakhstan and the official language of the host State.

7. The location of the consular post, its class and the consular district are determined by agreement with the host State.
Chapter 2. Organization of activities of consular institutions

8. Consular offices are divided into the following classes: Consulates General, consulates, Vice consulates and consular agencies.
There are consular departments at diplomatic missions that perform consular functions.
The consular department of a diplomatic mission is established by the head of the diplomatic mission in the territory of the receiving State or the territory of another State in which the diplomatic mission is accredited concurrently.
9. A consular post is opened in the territory of the receiving State only with the consent of that State.
10. Consular offices operate under the direction of the Ministry and the diplomatic mission in the receiving State (if any) or on behalf of the Ministry under the direction of the diplomatic mission in another State.
11. The consular offices submit reports on the consular service to the Ministry.
12. Consular offices are established, reorganized and cease their activities on the basis of:
1) decrees of the President of the Republic of Kazakhstan - Consulates General;
2) resolutions of the Government of the Republic of Kazakhstan - consulates, vice consulates and consular agencies.
13. Changing the location of a consular post within the host State does not require the adoption of an additional act provided for the opening of a consular post, and is carried out by a decision of the Minister of Foreign Affairs of the Republic of Kazakhstan (hereinafter referred to as the Minister).
14. Consular offices and their staff enjoy privileges and immunities in the receiving State in accordance with the legislation of the receiving State, generally recognized principles and norms of international law, and international treaties ratified by the Republic of Kazakhstan and the receiving State.
15. The establishment of consular relations of the Republic of Kazakhstan with other States is carried out by mutual agreement. Consent to establish diplomatic relations means, unless otherwise agreed, consent to establish consular relations.
16. Consular offices, within their competence, interact with government agencies and organizations of the Republic of Kazakhstan with the notification of the Ministry.

16-1. Consular offices in accordance with the procedure established by the legislation of the Republic of Kazakhstan:
1) They carry out the acquisition, registration, acceptance and storage of diplomatic mail, organize the delivery of diplomatic mail from the Ministry to other foreign institutions of the Republic of Kazakhstan.;
2) they carry out the acquisition, storage and registration of diplomatic mail for delivery to the Ministry;
3) arrange the delivery of diplomatic mail to the Ministry;
4) Take measures within their competence to ensure the safety and security of diplomatic mail during its delivery;
5) They ensure the registration and issuance of documents for the delivery of diplomatic mail to diplomatic couriers and ad hoc couriers.

17. The reception and processing of documents received from individuals and legal entities for consular functions is carried out on the territory of the Republic of Kazakhstan by employees of the Ministry and the republican state enterprise subordinate to the Ministry on the right of economic management, contributing to the implementation of tasks assigned to the Ministry, abroad – by diplomatic missions and consular offices.

18. Logistical support for the implementation of consular functions in the territory of the Republic of Kazakhstan is provided by the Ministry and the republican state enterprise subordinate to the Ministry on the right of economic management, contributing to the implementation of the functions assigned to the Ministry.
Chapter 3. Head and staff of the consular institution
19. Consulates General, consulates, Vice consulates, and consular agencies are headed respectively by Consuls General, consuls, vice consuls, and consular agents.
Consular departments of diplomatic missions are headed by heads of consular departments.
20. Upon appointment to the post, the head of the consular institution is issued a written authorization – a consular patent, signed by the Minister or the person performing his duties, which indicates the full name and surname, the class of the consular institution, the consular district and the location of the consular institution in the receiving State.
When granting a consular patent to an honorary consul, his nationality is additionally indicated.

21. The head of the consular institution begins to perform his duties after receiving the permission of the host State - the exequatur. With the exception of the cases provided for in paragraph 22 of this Statute, the head of the consular institution may not begin to fulfill his obligations until he receives an executive order.
22. With the consent of the receiving State, the head of the consular institution is temporarily allowed to perform consular functions until an executive order is issued.
If the head of a consular post is unable to perform his functions for any reason or the position of head of the consular post is temporarily vacant, the temporary performance of his duties is carried out by the consul of this or another consular post (diplomatic mission) as determined by the Ministry.
If the head of the consular institution is outside the country of residence or on work leave due to official necessity, the temporary performance of his duties is carried out by the consul of this consular institution, designated by the head of the consular institution.
23. Head of the Consular post:
1) protects the rights and interests of individuals and legal entities of the Republic of Kazakhstan by all lawful means and methods;
2) informs the Ministry of Internal and Foreign Policy in the consular district;
3) ensures the development of cooperation between the Republic of Kazakhstan and the host State;
4) take the necessary measures to ensure in the receiving State the privileges and immunities granted to the consular institution, staff and members of their families in accordance with the norms of international law and the legislation of the receiving State;
5) coordinates with the Ministry trips on short-term business trips outside the consular district;
6) performs other functions assigned to its competence by legislation and international treaties ratified by the Republic of Kazakhstan.
24. The head of the consular institution has the right:
1) submit proposals to the Ministry in accordance with the established procedure on issues of bilateral relations with the host State;
2) receive, in accordance with the established procedure, the necessary materials and documents from state bodies and organizations of the Republic of Kazakhstan on issues within the competence of the consular institution;
3) submit proposals to the Ministry on awarding the staff of the consular institution with state awards, promotion in rank and position, early secondment or extension of work abroad, imposition of disciplinary penalties;
4) manage the limit of funds (expenses) provided for in the consular institution's financing plan;
5) to issue orders on the activities of the consular institution, in coordination with the Ministry, to make decisions on issues related to labor relations with service personnel, to approve the schedule of annual paid work vacations of the staff of the consular institution;
6) in agreement with the head of the diplomatic mission in the receiving state (if any), allow short-term trips of the staff of the consular institution and their family members outside the consular district, with the exception of cases of departure when providing annual paid leave.;
7) to conduct an inquiry into cases of criminal offenses committed by its employees in the host country, in accordance with the procedure established by a joint order of the Prosecutor General of the Republic of Kazakhstan and the Minister.
25. Consular staff and family members must comply with the laws of the receiving State, respect local traditions and refrain from any actions that may be considered interference in the internal affairs of the receiving State.
26. Consuls operating outside the Republic of Kazakhstan are subject to the working conditions of the staff of the diplomatic service of the Republic of Kazakhstan abroad, determined by the Government of the Republic of Kazakhstan.

Chapter 4. Consular functions and their performance

27. Consular functions are performed on behalf of the Republic of Kazakhstan:
1) in the territory of the Republic of Kazakhstan – by the Ministry;
2) outside the Republic of Kazakhstan:
diplomatic missions and consular offices;
other States with which the relevant international treaty of the Republic of Kazakhstan has been concluded, with the consent of the host State.

28. The head of the consular institution performs the functions assigned to him personally.
The performance of certain consular functions may be assigned to another consul in a consular post on the basis of an order from the head of the consular post, in a diplomatic mission - by the head of the diplomatic mission.
29. Personal responsibility for the observance of legality in the performance of consular functions in a consular institution lies with the head of the consular institution, in a diplomatic mission - the head of the diplomatic mission and the head of the consular department.
30. Consular functions are performed by the consul within the consular district. The performance of consular functions outside the consular district is carried out in exceptional cases on behalf of the Ministry with the consent of the host State.
31. The performance of consular functions by a consul on behalf of another State may be carried out by agreement with that State and with the consent of the receiving State.
32. The consul makes a detour of his consular district at least once a year.
33. The Consul takes measures to ensure the inviolability of the consular archive.
34. The consul has the right to contact the authorities of the receiving State within his consular district on all issues related to the activities of the consular institution.
35. The Consul accepts written and oral statements from individuals and legal entities of the Republic of Kazakhstan, as well as foreign individuals and legal entities on issues related to his consular activities.
36. Complaints about the actions (inaction) of consular officials are filed and considered in accordance with the requirements of the Administrative Procedural Procedure Code of the Republic of Kazakhstan.

37. Consular functions include:
1) taking measures to protect the rights and legitimate interests of individuals and legal entities of the Republic of Kazakhstan;
2) consular registration of citizens of the Republic of Kazakhstan;
3) consideration of issues of citizenship of the Republic of Kazakhstan;
4) issuance, restoration, cancellation, extension and shortening of the validity period of visas of the Republic of Kazakhstan;
5) issuance and seizure of identity documents;
6) registration of civil status acts of the Republic of Kazakhstan;
7) adoption, custody and guardianship of citizens of the Republic of Kazakhstan staying abroad;
8) obtaining a permanent residence permit for citizens of the Republic of Kazakhstan abroad;
9) legalization of documents;
10) performing notarial acts;
11) requesting documents;
12) realization of electoral rights of citizens of the Republic of Kazakhstan;
13) taking measures in the field of sanitary, phytosanitary and veterinary protection;
14) assistance to aircraft, ships of the sea and river fleet, means of automobile and railway transport of the Republic of Kazakhstan;
15) taking measures to protect the property of citizens of the Republic of Kazakhstan;
16) protection of the rights and interests of citizens of the Republic of Kazakhstan who find themselves in a difficult situation, including as a result of force majeure, as well as taking measures against deceased citizens of the Republic of Kazakhstan in the host state;
16-1) issuance of other documents (certificates) of legal significance;
17) taking measures against citizens of the Republic of Kazakhstan who are under arrest, imprisoned, taken into custody or detained, as well as searching for missing citizens of the Republic of Kazakhstan on the territory of the consular district.

38. Consular fees are charged for performing consular actions in accordance with the tax legislation of the Republic of Kazakhstan.

39. The legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan may provide for other consular functions.
Chapter 5. Functions of the Consul in relation to individuals and legal entities of the Republic of Kazakhstan

40. The Consul takes measures to ensure that individuals and legal entities of the Republic of Kazakhstan enjoy in full all the rights granted to them by the legislation of the receiving State and international treaties ratified by the Republic of Kazakhstan.
41. The Consul provides assistance to citizens of the Republic of Kazakhstan located in the territory of the consular district in order to protect and ensure their rights and interests in accordance with the legislation of the Republic of Kazakhstan and the host State.
42. The Consul takes measures to restore the violated rights of individuals and legal entities of the Republic of Kazakhstan.
43. The Consul informs citizens of the Republic of Kazakhstan temporarily staying in his consular district about the current legislation of the host state, as well as local customs.
44. The Consul's orders on issues related to the stay of citizens of the Republic of Kazakhstan abroad are binding on them.
45. The consul has the right, without a power of attorney, to represent citizens of the Republic of Kazakhstan in the institutions of the host state if they are absent or unable to attend in person for financial reasons or illness and have not entrusted the case to any person, or are unable to protect their interests for other reasons. This representation continues until the representatives appoint their representatives or take upon themselves to protect their rights and interests.
Chapter 6. Functions of consular registration of citizens of the Republic of Kazakhstan

46. The Consul keeps records of citizens of the Republic of Kazakhstan permanently residing and temporarily staying in his consular district.
Chapter 7. Functions of the Consul for Citizenship of the Republic of Kazakhstan

47. The Consul:
1) accepts applications for citizenship of the Republic of Kazakhstan from persons permanently residing outside the Republic of Kazakhstan and, together with the necessary documents, sends them to the President of the Republic of Kazakhstan for consideration through the Ministry;
2) registers the loss of citizenship of the Republic of Kazakhstan by persons residing outside the Republic of Kazakhstan;
3) determines the affiliation (non-affiliation) to the citizenship of the Republic of Kazakhstan of persons residing outside the Republic of Kazakhstan;
4) notify persons permanently residing outside the Republic of Kazakhstan of the decision taken by the President of the Republic of Kazakhstan on the issue of citizenship of the Republic of Kazakhstan.

Chapter 8. Functions of the Consul for issuing visas of the Republic of Kazakhstan

48. The Consul:
1) issues, cancels, restores visas of the Republic of Kazakhstan, as well as extends and shortens their validity periods, or, in accordance with the legislation of the Republic of Kazakhstan, decides to refuse to issue visas of the Republic of Kazakhstan to foreign citizens and stateless persons;
2) forms a unified database for the issuance of entry visas to foreign citizens and stateless persons, ensures systematic updating of information, and also carries out timely information exchange with the internal affairs and national security authorities of the Republic of Kazakhstan;
3) informs ethnic Kazakhs who have expressed a desire to voluntarily relocate to the Republic of Kazakhstan about the conditions of entry, including to the regions determined by the Government of the Republic of Kazakhstan, within the framework of regional quotas for the admission of Kazakhs, admission conditions and social support measures;
4) accepts and registers the documents of immigrants, including ethnic Kazakhs, who have applied for entry into the Republic of Kazakhstan, sends them to the authorized body on population migration, issues visas for entry into the Republic of Kazakhstan for permanent residence.

Chapter 9. Functions of the Consul for the issuance and seizure of identity documents

49. The Consul:
1) accepts and transmits documents for the production of passports of citizens of the Republic of Kazakhstan who are abroad;
2) issues certificates of return to the Republic of Kazakhstan;
3) withdraw identity cards from citizens of the Republic of Kazakhstan who have received documents for the right of permanent residence abroad, and passports of a citizen of the Republic of Kazakhstan - in case of acquisition of citizenship of another state.

50. The issuance and seizure of identity documents are carried out in accordance with the procedure provided for by the Law of the Republic of Kazakhstan dated January 29, 2013 "On Identity Documents".
Chapter 10. Functions of the Consul for registration of civil status acts

51. The Consul:
1) carries out the registration of civil status acts of citizens of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan;
2) takes measures to introduce amendments, additions and corrections to the civil status records, as well as to restore and cancel the civil status records of citizens of the Republic of Kazakhstan, foreign citizens and stateless persons who have registered civil status records with the civil status registration authorities of the Republic of Kazakhstan.

Chapter 11. Functions of the Consul in relation to adoption, custody and guardianship of citizens of the Republic of Kazakhstan staying abroad

52. The Consul keeps records of foreign citizens wishing to adopt children who are citizens of the Republic of Kazakhstan, in accordance with the legislation of the Republic of Kazakhstan on the rights of the child.

53. The Ministry carries out registration of children who are citizens of the Republic of Kazakhstan, who have been placed for adoption by foreign citizens, in accordance with the legislation of the Republic of Kazakhstan on the rights of the child.
The procedure for registration with the Ministry and the monitoring by foreign institutions of the Republic of Kazakhstan of children who are citizens of the Republic of Kazakhstan placed for adoption by foreign citizens is approved by order of the Minister.

54. The consul within the consular district oversees the children placed for adoption by foreign citizens.

55. The Consul takes measures to ensure that adoptive parents who are foreign citizens permanently residing in the territory of the consular district provide reports on the living conditions, education, upbringing and health status of adopted children.

56. The Consul takes measures to establish custody and guardianship over minor citizens of the Republic of Kazakhstan who are in his consular district and who have been left without parental care.
The Consul also takes measures to establish guardianship over adult citizens of the Republic of Kazakhstan who, for health reasons, cannot independently exercise their rights and perform their duties.
Chapter 12. Functions of the Consul for obtaining permanent residence permits for citizens of the Republic of Kazakhstan abroad

57. The Consul accepts documents for obtaining a permanent residence permit abroad for citizens of the Republic of Kazakhstan who have temporarily left the Republic of Kazakhstan and have expressed a desire to obtain permanent residence in a foreign country.

58. Notifications on permanent residence abroad for citizens of the Republic of Kazakhstan who have temporarily left and expressed a desire to arrange permanent residence abroad are issued by the consul on the basis of permits from the internal affairs bodies of the Republic of Kazakhstan.

59. The procedure for receiving and sending documents of citizens of the Republic of Kazakhstan who have left the Republic of Kazakhstan on temporary business and have expressed a desire to remain there for permanent residence is approved by the order of the Minister.
Chapter 13. Functions of the Consul for the legalization of documents

60. The consul accepts for legalization documents and acts drawn up or certified by the authorities of the consular district, as well as diplomatic missions and consular offices of foreign states accredited in the consular district.
The state bodies of the Republic of Kazakhstan accept documents and acts drawn up with the participation of the authorities of foreign states or emanating from these authorities for consideration in the presence of legalization, unless otherwise provided by the legislation of the Republic of Kazakhstan or an international treaty ratified by the Republic of Kazakhstan.
61. The legalization of documents is the establishment and attestation of the authenticity of an official's signature and seal on documents for the purpose of using them in another State.
62. The rules for the legalization of documents are approved by order of the Minister.
Chapter 14. The functions of the consul in matters of notarial acts

63. The consul performs the following notarial acts:
1) certifies transactions, except for agreements on the alienation of immovable property located in the territory of the Republic of Kazakhstan;
2) issues certificates of inheritance rights;
3) issues certificates of ownership of a share in the common property of the spouses and other persons who have property under the right of common joint ownership;
4) attests to the accuracy of copies of documents and extracts from them;
5) certifies the authenticity of the signature on the documents;
6) attests to the correctness of the translation of documents from one language to another;
7) certifies the fact that a citizen of the Republic of Kazakhstan is alive;
8) certifies the fact that a citizen of the Republic of Kazakhstan is in a certain place;
9) certifies the time of presentation of documents;
10) transmits applications from individuals and legal entities to other individuals and legal entities;
11) accepts money as a deposit;
12) accepts documents and securities for safekeeping;
13) commits maritime protests;
14) provides evidence.

Chapter 15. Functions of the Consul in matters of document recovery

66. The Consul provides assistance to citizens of the Republic of Kazakhstan, foreign citizens and stateless persons permanently residing in his consular district in requesting documents related to ensuring their rights and legitimate interests.
The request for documents consists in forwarding (delivery, transmission) of documents related to ensuring the rights and legitimate interests of citizens of the Republic of Kazakhstan, foreign citizens and stateless persons from the Republic of Kazakhstan or from abroad.

67. The procedure for requesting documents related to ensuring the rights and legitimate interests of citizens of the Republic of Kazakhstan, foreign citizens and stateless persons through the institutions of the Ministry of Foreign Affairs of the Republic of Kazakhstan is established by a joint order of the Minister and the Minister of Justice of the Republic of Kazakhstan.

68. The Consul provides assistance to citizens of the Republic of Kazakhstan in exercising their electoral rights, observing the principles of electoral law established by the legislation of the Republic of Kazakhstan.
69. In the case of the formation of a polling station in the premises of a foreign institution of the Republic of Kazakhstan during the elections of the President of the Republic of Kazakhstan, deputies of the Kurultai of the Republic of Kazakhstan and a national referendum, the diplomatic mission and (or) the consular institution officially inform the authorities of the consular district about this.

Chapter 17. The functions of the consul in fulfilling the instructions of state bodies and officials performing the functions of criminal prosecution and judicial authorities of the Republic of Kazakhstan

70. The Consul carries out assignments of state bodies and officials performing the functions of criminal prosecution and judicial authorities of the Republic of Kazakhstan in relation to citizens of the Republic of Kazakhstan in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan and international treaties of the Republic of Kazakhstan.
71. The Consul provides assistance in the performance of official duties to representatives of government agencies of the Republic of Kazakhstan located within the consular district.
Chapter 18. Functions of the Consul in taking measures in the field of sanitary, phytosanitary and veterinary protection

72. When quarantine diseases appear on the territory of the consular district, the consul informs the authorized bodies of the Republic of Kazakhstan in the field of sanitary, phytosanitary and veterinary protection, indicating the name and border of the infected area, the number of cases of diseases and anti-epidemic measures taken by local authorities.
The Consul informs persons who have received permission to enter the Republic of Kazakhstan about the need to submit international vaccination certificates upon entry into the Republic of Kazakhstan.

73. If dangerous diseases or pests of agricultural plants appear within the consular district, as well as in cases of mass diseases of livestock and poultry or the threat of the spread of diseases common to humans and animals, the consul reports this to the authorized bodies of the Republic of Kazakhstan in the field of sanitary, phytosanitary and veterinary protection.
74. The Consul informs persons who have received permission to enter the Republic of Kazakhstan about the need to submit veterinary certificates for animals, raw materials and products of animal origin upon entry into the Republic of Kazakhstan and the rules for importing seeds, live plants, planting materials, fresh fruits and vegetables into the Republic of Kazakhstan.

Chapter 19. Functions of the consul in relation to aircraft, ships of the sea and river fleet, means of automobile and railway transport of the Republic of Kazakhstan

75. The Consul takes measures to ensure that at the airports of the receiving State within his consular district, the commander, crew and passengers of an aircraft of the Republic of Kazakhstan (hereinafter referred to as the aircraft) are granted full rights in accordance with the legislation of the receiving State and international treaties ratified by the Republic of Kazakhstan and the receiving State.
76. The consul provides assistance to the commander, crew and passengers of the aircraft in relations with the authorities of the host State, and also takes measures to return, if necessary, the aircraft, its crew and passengers to the Republic of Kazakhstan or to continue the flight.
77. In cases of an accident, forced landing or other incident with an aircraft within the consular district, the consul provides the necessary assistance to the crew and passengers.
78. In cases of crimes committed on board an aircraft, the consul shall assist the aircraft commander in fulfilling duties arising from the legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan.
79. By agreement of the Ministry with the airlines of the Republic of Kazakhstan, the consul sends diplomatic mail and diplomatic cargo on aircraft of the Republic of Kazakhstan en route to the airports of the Republic of Kazakhstan at the rates agreed between the Ministry and the airlines of the Republic of Kazakhstan, as well as in accordance with the safety rules of the airlines of the Republic of Kazakhstan and in accordance with the legislation of the Republic of Kazakhstan.
80. In the event of a declaration of a state of emergency in the host country for various reasons or due to natural disasters, the consul provides assistance in the departure of citizens of the Republic of Kazakhstan on aircraft of the Republic of Kazakhstan en route to the airports of the Republic of Kazakhstan.
81. The provisions of paragraphs 75-80 of this chapter also apply to aircraft (helicopters) of the aviation of the Armed Forces of the Republic of Kazakhstan, ships of the sea and river fleet, as well as means of automobile and railway transport of the Republic of Kazakhstan.
82. In case of purchase of a marine vessel abroad, the consul issues a temporary certificate for the right to sail under the National Flag of the Republic of Kazakhstan.
Chapter 20. Functions of the consul to protect the rights and interests of citizens of the Republic of Kazakhstan who find themselves in a difficult situation, including due to force majeure, as well as to take measures in respect of deceased citizens of the Republic of Kazakhstan in the host State

83. In cases where a citizen of the Republic of Kazakhstan finds himself in a difficult situation and without means of livelihood in the host State due to force majeure, as well as a victim of criminal activities and human trafficking, and has reported this to a diplomatic mission or consular institution, the consul:
1) establishes the existence of obligations of the person or organization that invited this citizen of the Republic of Kazakhstan to reimburse expenses related to his stay in this state, and facilitates their fulfillment;
2) assists in establishing contacts of this citizen of the Republic of Kazakhstan with his family members, relatives or other persons;
3) provides financial assistance in accordance with the legislation of the Republic of Kazakhstan;
4) interacts with government agencies and organizations of the host State on the merits of the application.;
5) verifies the circumstances of a citizen of the Republic of Kazakhstan getting into a difficult situation and takes measures to verify the authenticity of materials, objects, documents and information submitted by a citizen of the Republic of Kazakhstan;
6) notify the Ministry of this case.

84. In case of death of a citizen of the Republic of Kazakhstan, the consul takes measures to bury him with due honors or send the body of the deceased to the Republic of Kazakhstan.
85. The implementation of measures to protect the rights and interests of citizens of the Republic of Kazakhstan who find themselves in a difficult situation, including due to force majeure, as well as the adoption of measures in respect of deceased citizens of the Republic of Kazakhstan in the host State are carried out in accordance with the procedure approved by the Minister of Foreign Affairs of the Republic of Kazakhstan in coordination with the central authorized body for budget planning.

Chapter 21. Functions of the Consul in relation to the property of citizens of the Republic of Kazakhstan

86. The Consul takes measures to protect the property left after the death of a citizen of the Republic of Kazakhstan for subsequent transfer to his heirs.
87. The Consul accepts money, valuables, securities and documents belonging to citizens of the Republic of Kazakhstan for safekeeping.
In the event of the death of the person who owned the deposited property, the provisions of paragraph 86 of this Statute shall apply to such property.
Chapter 22. Functions of the consul in relation to citizens of the Republic of Kazakhstan who are under arrest, imprisoned, taken into custody or detained, as well as the search for missing citizens of the Republic of Kazakhstan in the territory of the consular district

88. The Consul shall take measures to ensure that a citizen of the Republic of Kazakhstan who has been detained (arrested) or detained on suspicion of committing a crime, or has been subjected to other measures restricting freedom, or is serving a custodial sentence, as well as being subjected to other judicial or administrative measures, complies with the laws of the receiving State and international treaties, ratified by the Republic of Kazakhstan.
89. The Consul, at the request of interested persons and on his own initiative, visits citizens of the Republic of Kazakhstan in places of detention and finds out the conditions of their detention, takes measures to notify the receiving State of the need to keep such citizens of the Republic of Kazakhstan in conditions that meet the requirements of sanitation and hygiene, and that they are not subjected to cruel and degrading treatment..
90. The Consul shall refrain from taking any measures on behalf of a citizen of the Republic of Kazakhstan who is under arrest, imprisoned, taken into custody or detained, if there is a written objection by the said citizen of the Republic of Kazakhstan to taking such measures.

91. The consul applies to the competent authorities of the receiving State for assistance in the search for missing citizens of the Republic of Kazakhstan in the territory of his consular district.
Chapter 23. Activities of honorary Consulates

92. Honorary consuls perform consular functions on behalf of the Republic of Kazakhstan on behalf of the Ministry.

93. Honorary consulates are headed by honorary consuls appointed by the Minister with the consent of the host State.
A citizen of the Republic of Kazakhstan or another state is appointed Honorary Consul.

95. The functions and powers of honorary consuls are determined by order of the Minister.
