On some issues of protection of state secrets of the Republic of Kazakhstan
Decree of the President of the Republic of Kazakhstan dated November 7, 2017 No. 579.
In order to improve the system of protection of state secrets of the Republic of Kazakhstan, I HEREBY DECREE:
1. Reorganize the Office of the Prime Minister of the Republic of Kazakhstan by transferring functions and powers in the field of protection of state secrets of the Republic of Kazakhstan to the National Security Committee of the Republic of Kazakhstan.
2. To the Government of the Republic of Kazakhstan:
1) jointly with the National Security Committee of the Republic of Kazakhstan to ensure the introduction of amendments and additions to the regulatory legal acts of the Republic of Kazakhstan arising from this Decree;
2) ensure the transfer from the jurisdiction of the Office of the Prime Minister of the Republic of Kazakhstan to the jurisdiction of the National Security Committee of the Republic of Kazakhstan of the state institutions "Center for Training and Advanced Training of Information Security Specialists", "Center for Technical Information Protection" and the republican state-owned enterprise "Almas";
3) ensure the transfer of the appropriate staffing of the Office of the Prime Minister of the Republic of Kazakhstan to the National Security Committee of the Republic of Kazakhstan;
4) in accordance with the procedure established by law, take other measures arising from this Decree.
3. To make amendments and additions to the following decrees of the President of the Republic of Kazakhstan:
1) to the Decree of the President of the Republic of Kazakhstan dated April 1, 1996 No. 2922 "On Approval of the Regulations on the National Security Committee of the Republic of Kazakhstan":
in the Regulation on the National Security Committee of the Republic of Kazakhstan, approved by the above-mentioned Decree:
The second part of paragraph 1 should be worded as follows:
"The National Security Committee manages, within the limits of its powers, the unified system of national security agencies of the Republic of Kazakhstan (hereinafter referred to as the national security agencies), intelligence, counterintelligence, operational search activities, and protection of the State Border of the Republic of Kazakhstan (hereinafter referred to as the national security agencies). – State Border), the implementation of the tasks of the Government Communications Service and the Special Purpose Service "A", interdepartmental coordination in the areas of activity within its competence, as well as a unified policy on the protection of state secrets and is the authorized body for the protection of state secrets in the Republic of Kazakhstan.";
Paragraph 11 should be supplemented with sub-paragraphs 8-7) and 8-8) as follows:
"8-7) implementation of a unified state policy in the field of protection of state secrets;
8-8) development of legal, administrative, economic, technical, programmatic and cryptographic measures to protect state secrets;";
Add sub-paragraphs to paragraph 12 64-24), 64-25), 64-26), 64-27), 64-28), 64-29), 64-30) and 64-31) as follows:
"64-24) implements a unified state policy in the field of protection of state secrets in government agencies and organizations, develops and improves the system of protection of state secrets;
64-25) develops a system of legal, administrative, economic, technical, programmatic and cryptographic measures to protect state secrets;
64-26) organizes the training and retraining of personnel of departments for the protection of state secrets;
64-27) provides practical and methodological assistance to government agencies and organizations on the protection of information constituting state secrets;
64-28) organizes decryption work in the national security agencies;
64-29) Develops, coordinates and approves technical regulations in areas of activity within the competence of national security agencies, as well as monitors compliance with the requirements established by technical regulations.;
64-30) technically carries out counterintelligence, special operational search activities related to the use of a communication network in the interests of solving tasks by all bodies engaged in counterintelligence, operational search activities.;
64-31) distributes and records radio frequencies allocated by the central executive body of the military administration of the Republic of Kazakhstan for use by national security agencies;";
in paragraph 16:
Sub-paragraph 124-6) should be deleted;
add subparagraph 125-49) to read as follows:
"125-49) sets prices for goods (works, services) produced and sold by the republican state-owned enterprise Almas;";
The section "List of organizations under the jurisdiction of the National Security Committee" should be supplemented with paragraph 3 as follows:
"3. Republican state-owned Enterprise Almas of the National Security Committee of the Republic of Kazakhstan.";
The subsection "National Security Committee" of the section "List of State institutions under the jurisdiction of the National Security Committee and its departments" should be supplemented with paragraphs 15 and 16 as follows:
"15. Center for Technical Information Protection of the National Security Committee of the Republic of Kazakhstan.
16. The Center for training and advanced training of information security specialists of the National Security Committee of the Republic of Kazakhstan.";
2) classified.
4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
5. This Decree will enter into force on January 1, 2018.
