Decree of the President of the Republic of Kazakhstan dated October 10, 2019 No. 186

 In accordance with subparagraph 1) of Article 8 of the Law of the Republic of Kazakhstan dated May 30, 2005 "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE:

     1. To approve the attached draft Protocol on Amendments to the Agreement between the Republic of Kazakhstan and Mongolia on Mutual Legal Assistance in Civil and Criminal Matters dated October 22, 1993.

     2. To authorize the Minister of Justice of the Republic of Kazakhstan, Marat Bakytzhanovich Beketaev, to sign on behalf of the Republic of Kazakhstan the Protocol on Amendments to the Agreement between the Republic of Kazakhstan and Mongolia on Mutual Legal Assistance in Civil and Criminal Matters dated October 22, 1993, authorizing amendments and additions that are not fundamental.

     3. This Decree shall enter into force from the date of its signing.

Protocol on Amendments to the Agreement between the Republic of Kazakhstan and Mongolia on Mutual Legal Assistance in Civil and Criminal Matters dated October 22, 1993

     The Republic of Kazakhstan and Mongolia (hereinafter referred to as the "Contracting Parties"),

     Based on article 40 of the Treaty between the Republic of Kazakhstan and Mongolia on Mutual Legal Assistance in Civil and Criminal Matters dated October 22, 1993 (hereinafter referred to as the Treaty),

     We have agreed on the following:

Article 1

     1. In the name of the Agreement in the Kazakh language, the words "ozara komek turaly" should be replaced with the words "ozara kukyktyk komek turaly";

     the name of the Agreement in Mongolian and Russian does not change.

     2. Article 4 of the Agreement should be worded as follows:

"Article 4 Procedure for communication in the provision of legal assistance

     When providing legal assistance, the competent authorities of the Contracting Parties communicate with each other through the central authorities, unless this Agreement establishes a different procedure for communication.

     The central authorities are:

     for the Republic of Kazakhstan - the Supreme Court of the Republic of Kazakhstan in terms of requests (orders) from courts, as well as petitions for recognition and enforcement of judgments in civil cases; the Prosecutor General's Office of the Republic of Kazakhstan in terms of requests (orders) in criminal cases during pre-trial investigation, as well as petitions for recognition and enforcement of sentences in terms of compensation for damages in criminal cases; The Ministry of Justice of the Republic of Kazakhstan regarding other requests (orders) from other institutions, as well as notaries and lawyers;

     for Mongolia, the Ministry of Justice and Internal Affairs of Mongolia, the General Prosecutor's Office of Mongolia and the Supreme Court of Mongolia.

     In the event of a change in the powers or functions of the central authorities of the Contracting Parties, a corresponding written notification is sent through diplomatic channels.".

     3. Delete Article 27 of the Treaty.

Article 2

     This Protocol is an integral part of the Treaty and shall enter into force on the date of receipt through diplomatic channels of the last written notification by the Contracting Parties on the completion of the necessary domestic procedures.

     This Protocol shall terminate simultaneously with the termination of the Agreement.
